Wise Gas, Inc. has applied for a Minor Adjustment to a Minor Site Plan project known as Port Consolidated to add compressed gas facilities to an existing diesel fueling station located at 121 North Jenkins Road, in IL the (Industrial, Light) Zoning District, for the property described in Part B below. B. On May 16, 2005, the Growth Management Director, through GM Order 05-014, granted Minor Site Plan approval for the industrial project known as Port Consolidated. C. The Development Review Committee has reviewed the site plan application and found, with the proposed conditions, it meets the technical requirements of the St. Lucie County Land Development Code and has satisfied the standards of review set forth in Section 11.02.07, Standards for Site Plan Review, of the Land Development Code. D. Planning Staff has performed a detailed analysis of the project and determined it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is found in the Development Review Committee Final Report for the Port Consolidated — CNG Refueling Minor Adjustment to a Minor Site Plan, dated November 18, 2016. E. A Certificate of Capacity Exemption issued on November 17, 2016 is attached, as required under Chapter V, St. Lucie County Land Development Code. NOW, THEREFORE, BE IT ORDERED: A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the proposed Minor Adjustment to the Minor Site Plan project known as Port Consolidated-CNG is hereby approved as shown on the site plan drawings for the project prepared by Boggs Planning & Landscape Architecture, dated September 14, 2016, revised through November 7, 2016, and November 23, 2016 PDS Order 16-054 SPMN 920165063 Page 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 KIy 27 28 29 30 31 32 33 34 35 36 37 38 39 date stamped received by the St. Lucie County Planning Division on November8, 2016, subject to the following conditions: 1. Within 90 days of site plan approval or prior to issuance of a development permit, whichever occurs first, the property owners, successors or assigns shall convey to St. Lucie CountVS�ft'Lita?f the-petitioned=property'foMhe-future*right=ofzway-needsalong North Jenkins Road. Such dedication shall be in a manner and form acceptable to the County Attorney. 2. Prior to issuance of a certificate of occupancy and/or finalization of building permit approval, the applicant shall-install=landscaping-where-notfin-eotrfplia' nce�-itR"e approved landscape plan approved through G M-05-014 dated 9/15/04 prepared by Dewey S. Thurmond Landscape Architect and remove all Florida Exotic Plant Pest Council Category I listed invasive species onsite (specifically Brazilian pepper). 3. The issuance of a County development permit does not in any way create any rights on the part of the applicant to obtain a permit from a state orfederal agency and does not create any liability on the part of the County if the applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. 4. All other applicable state or federal permits must be obtained before commencement of the development. B. The property on which this Minor Adjustment to a Minor Site Plan approval is being granted is described as follows: Beginning at a point on the Westerly line of Jenkins Road (26' feet wide) at a point distant 418.84 feet Northwardly from the Northerly line of Orange Avenue (110.5' wide) and extending: 1.) N00' 04' S1 E, in and along the said line of Jenkins Road, 200.00 feet to a point, thence, 2.) S89° 41' 22" W, 591.27 feet to a point, thence, 3.) S00- 05' 03" W, 621.68 feet to a point in the Northwesterly line of Orange Avenue; thence, 4.) N89° 30' 33" E, in and along the said Northerly line of Orange Avenue, 25.00to a point, thence 5.) N00° 05' 03" E, 421.68 feet to a point, thence 6.) Subject to a Drainage Maintenance Easement in the South 15 feet of the East 200 feet Also, subject to a Sign Maintenance Easement in the South 50 feet of the West 25 feet. The above Legal Description fall in the N.E. % of Section 12, Township 395, Range 39E. Address: 121 North Jenkins Road Parcel ID#: 2312-144-0001-0004 C. The developer is advised as part of this minor adjustment approval that the developer or any successor in interest shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and South Florida Water Management District, and the St. Lucie County Environmental Resources and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this approval by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developerfails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agencyor undertake actions that may result in a violation of state or federal law. D. This Order shall become effective upon the date of approval indicated below. Should the property owner, developer or authorized agent wish to appeal any condition described in Part A above, all such appeals must be filed in writing with the County Administrator within 30 days of the rendering of this Order, as described in Section 11.02.04(B), St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place orithe processing of this development project until the appeal is resolved. E. A copy of this Order shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie Plan"g-and Development Services Director. F. The conditions set forth in Part A are an integral nonseverable part of the site plan approval granted by this Order. If any condition set forth in Section A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this order shall become null and void.
