HLM Environmental (Applicant) will respectfully choose #2 from the potential options supplied by your department below. 2) The applicant may request a Policy Determination (WDA) of Leslie which seeks reasonable setback concessions for "temporary" remediation equipment, which would consider and possibly require the following of the applicant: Location: Setbacks from ROW/Adjacent Property, impacts to required parking, landscaping, utilities, etc. (Such determination may include landscape screening and certification of noise level adherence) Period allowed: Proposed timeline; this temporary fixture permit shall expire after one year. In some instances, but may be renewed via application and approval. (Such determination may include a not to exceed 3 or 5 years.) Security: Security for performance of the applicant's obligations, including removal of any structures, equipment and materials, shall be posted when determined necessary by the director of planning & development services. The security, including an agreement, may be a performance bond, cash, time certificate of deposit payable to the city and/or other negotiable instrument, including title. At the property owners request HLM has placed the system as far away from Mr. Emmons Business, Celebrity Auto Sales, as possible. This will also give some buffer for needed maintenance and running sound levels. The area designated for installation on the west side of the rear of the building will leave Mr. Emmons room to move, wash and park cars for his business, this is a very crowded site with no other options. He was adamant about the choice of this location. As an Agency Term Contractor for the Florida Department of Environmental Protection (FDEP) it is our core mission to complete the most cost effective site restoration while facilitation the property/business owners activities. The primary goal is to remove petroleum contamination from the site and return the property value to its appropriate commercial market value. There are no landscape changes or removal of established plants, the noise level for the system runs around 60DB at all times. There is no parking, utilities or businesses in close proximity of the proposed system location. There is an existing concrete fence on the property boundary. The system time of use falls in the proposed timeline of the temporary fixture permit. HLM has projected that time on site will be no more than 2.5 years. Governor Noah Valenstein Secretary Below is the Site Closure portion of the Florida Department of Environmental Protection's (FDEP) Agency Term Contract (ATC), which HLM Environmental Remediation, LLC follows during the execution of each job as detailed in the Scope of Work (SOW) that our office provides as an FDEP Contracted Local Program. (Exert from the State of Florida FDEP ATC contract concerning site closure after remediation is completed.) (FDEP Amended & Restated Agency Term Contract No. GC763, Attachment A (V2.0), Page 5 of 82) D. Site Closure: The Contractor will perform all aspects of site closure in accordance with applicable rules and guidance of the DEP and other government entities. The Contractor is expected to make professional recommendations for a No Further Action closure according to the applicable criteria for Risk Management Options Level I, II, and III in Chapter 62-780, F.A.C. The Contractor will also provide technical details and professional recommendations to support proposed institutional and/or engineering controls. Lastly, the Contractor will facilitate the grouting and abandonment of all borings and wells, draining and capping of all subsurface system conduits, removal of equipment and equipment compounds and other activities associated with returning the site as near as practicable to the conditions that preceded remedial action. Examples of work to be performed under this contract include but are not limited to: 1. Prepare no further action with conditions packages with supporting documentation, perform or oversee professional land surveys required to reflect engineering and/or institutional controls and assist in the preparation and filing of required deed restrictions and/or notices. 2. Provide P.E. certification of sufficiency of engineering control along with monitoring and maintenance recommendations, and design and install engineering controls. Perform remediation system decommissioning, removal and transfer or disposal and perform proper abandonment of monitoring wells, treatment wells, treatment system conduits and vaults. 4. Perform general site restoration as close as practicable to conditions that preceded remedial action. 5. Prepare Site Rehabilitation Completion and well abandonment reports. The DEP reserves the right to task the Contractor to perform services that are deemed necessary by the DEP to be performed, which are related to the services outlined herein, but which are not specifically set out herein.
