I've read it and offer the following interpretation. The intent of wall and fence height limitations in residential districts is to allow for reasonable privacy in the private section of the property, up to 6', and to allow for a sense of enclosure in the front yard area without creating a fortress impression, up to 4'. Occasional columns exceeding the height restrictions by a reasonable percentage is architecturally appropriate and does not violate the intent of the Code section. While a 20% increase in height, as proposed, would generally be too great for repeating columns, it is appropriate surrounding an entrance feature such as a gate. The text of the code does not speak to column height, therefore it is within the Director's discretion to interpret the intent and to make a policy decision. This is an after the fact permit. The wall and columns are already there. This is an entrance feature to support a gate. The walls are 3.67' high but the columns are 5' high. There are a total of 6 columns, two are at front property line and 4 setback about 17' from property line. Chapter 8.00.04 from LDC allows a 4' wall, hedge or fence in the front setback. Can we accept the height of the columns since the wall is meeting? The rest of the property has chain -link fence.
