LUCIE COUNTY, FLORIDA, GRANTING A MAJOR ADJUSTMENT TO HARBOUR RIDGE FINAL PLANNED UNIT DEVELOPMENT (PUD) MAINTENANCE AREA SITE PLAN FOR THE PROJECT TO BE KNOWN AS HARBOUR RIDGE LAKESIDE ACTIVITY CENTER WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: 1. Harbor Ridge POA, Inc. presented a petition for a Major Adjustment to the Final Planned Unit Development (PUD) Site Plan known as Harbour Ridge DRI located at 13490 Gilson Road, as depicted on the attached map as Exhibit "A" and described in Part "A" below. The subject +/- 3.47 acre parcel is zoned PUD (Planned Unit Development) and has a Future Land Use designation of RE (Residential, Estate — 1 du/acre). The Site Plan Adjustment will result in removal of the existing 3,262 ft2 maintenance building, construction of an approximate 8,000 ftZ Activity Center, six (6) pickle ball courts, the expansion of vehicular and golf cart parking area, and associated landscaping. 2. On January 12, 1982, the Board of County Commissioners adopted Resolution No. 82-6 authorizing a zoning change from AR-1 (Agricultural, Residential — 1) to PUD (Planned Unit Development) for approximately 885 acres. 3. On December 21, 1982, the Board of County Commissioners adopted Resolution No. 82-172 authorizing a Development of Regional Impact (DRI) for Harbour Ridge DRI consisting of 814 dwelling units and associated recreational amenities. 4. On March 3, 2020, this Board held a public hearing on the petition, after publishing notice at least ten (10) days prior to the hearing and notifying by mail all owners of property within 500 feet of the subject property. 5. The St. Lucie County Development Review Committee (DRC) has reviewed the Major Adjustment to Final PUD Site Plan for Harbour Ridge PUD and found it to meet all technical requirements, subject to the conditions set forth in Part "B" of this Resolution and determined that the Major Adjustment to Final PUD Site Plan is in substantial conformity with the previous approved PUD Site Plan. 6. The proposed project is consistent with the general purpose, goals, objectives, and standards of the St. Lucie County Land Development Code, the St. Lucie County Comprehensive Plan, and the Code of Ordinances of St. Lucie County. 7. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 8. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. The proposed project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 10. The proposed project will be served by the Harbour Ridge Utilities for water and wastewater services. 11. The applicant has applied for and received a Certificate of Capacity, a copy of which is attached to this Resolution as Exhibit B, as required under Chapter V, St. Lucie County Land Development Code. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A. The property on which the Major Adjustment to Final PUD Site Plan is being granted is described as follows: MAINTENANCE AREA, HARBOUR RIDGE PLAT NO. 2, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 24, PAGE 5, OF THE PUBLIC RECORDS OF SAINT LUCIE COUNTY, FLORIDA. Parcel ID No.: 4425-701-0032-000-2 B. Pursuant to Section 11.02.05(F) of the St. Lucie County Land Development Code, the Major Adjustment to Final PUD Site Plan known as Harbour Ridge PUD is hereby approved as shown on the revised site plan drawings for the project prepared by Lucido and Associates, dated February 3, 2020, and date stamped received by the St. Lucie County Planning & Development Services Department on February 0, 2020, subject to the following conditions: 1. Prior to the issuance of a Vegetation Removal Permit or Exemption, an updated gopher tortoise survey per Florida Fish and Wildlife Conservation Commission protocol, shall be provided to the Environmental Resources Department. Should the survey show impacts within 25 ft. of any burrows a Florida Fish and Wildlife Conservation Commission permit shall be required. 2. Prior to issuance of a Certificate of Occupancy, all Category I listed invasive species shall be eradicated from the site. 3. Prior to issuance of a Vegetation Removal Permit/Exemption, the applicant shall provide the required executed conservation easement for the preserve areas and the Environmental Resources Department -approved Preserve Area Monitoring and Management Plan (PAMMP) with attached affidavits, and a cashier's check, payable to the Clerk of the Court for the appropriate recording fees, to the County Attorney for review and approval. 4. Prior to issuance of a Vegetation Removal Permit/Exemption, the applicant shall provide a georeferenced shapefile or CAD file of the conservation easement boundaries to the Environmental Resources Department. 5. Prior to the issuance of a Building Permit or within 90 days of site plan approval whichever comes first the developer shall submit for a development permit with the Water Quality Engineering Department indicating the location of a six foot wide sidewalk along Gilson Road or enter into an agreement to pay a fee in lieu of construction of a sidewalk. The fee shall be based on an approved engineers estimate utilizing the unit cost provided by the Water Quality Engineering Department. The acceptable method of payment shall be a certified check payable to St. Lucie County. Page 2 Resolution 2020-037 March 3, 2020 File No.: SPMj-10201925615 OR BOOK 4396 PAGE 2738 C. The approvals and authorizations granted by this Resolution shall expire on March 3, 2022 unless a building permit is secured or a site plan extension is granted in accordance with Section 11.02.06(B)(3) of the St. Lucie County Land Development Code. D. The property owner, including any successors in interest, shall obtain all applicable development permits and construction authorizations from the appropriate State, Federal and Local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, Florida Department of Transportation, South Florida Water Management District, Fort Pierce Utilities Authority, St. Lucie County Utilities, St. Lucie County Environmental Resources Department, Public works Department, and the Building Department prior to the commencement of development activities on the property. Issuance of any permit by St. Lucie County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of St. Lucie County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a State or Federal agency or undertake actions that may result in a violation of State or Federal law. E. The conditions set forth in Part "B" are an integral non -severable part of the site plan approval granted by this Resolution. If any condition set forth in Part "B" is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this Resolution shall become null and void. F. A recorded copy of this Resolution shall be attached to the site plan drawings described in Part "B", which shall be placed on file with the St. Lucie County Planning and Development Services Department Director. G. This Resolution shall be recorded in the Public Records.
