Recording Secretary 25 26 Staff introduced themselves 27 28 ANNOUNCEMENTS 29 None 30 31 AGENDA ITEM #1 – MINUTES OF October 26, 2016 32 Chief Foxx motioned approval of the minutes as written. 33 Mr. Harris seconded and the motion carried unanimously. 34 35 AGENDA ITEM #2 – Public Comments 36 None 37 38 AGENDA ITEM #3–Petition of Stephen Basile for a variance from the provisions of Section 39 4.01.04(Hutchinson Island Height Limitations) of the St. Lucie County Land Development Code 40 to allow for the construction of a single family residence to exceed the maximum 35 foot 41 Page 2 of 2 APPROVED BOA Minutes June 28, 2017 building height requirement by 3.5 feet, for a total building height of 38.5 feet. The subject 42 property is located at 6600 North A1A. Staff report by Jeff Johnson. 43 44 Jeff Johnson, Senior Planner presented staff comments for the application of Stephen Basile for 45 requesting a variance from the provisions of the Land Development Code, Section 4.01.04 46 (Hutchinson Island Height Limitations) which regulates building heights on Hutchinson Island by 47 placing within one of two overlay zones. The intent is to ensure that development in the coastal area 48 is compatible with the physical and environment characteristics of the coastal property as per 49 Comprehensive Plan Policy 5.1.1.1. The applicant is requesting relief from the height restriction for 50 the single family residence. The land to the north, south and west are State owned vacant lands. 51 Staff recommends denial as the variance sought does not arise from conditions that are unique and 52 peculiar to the land and physical environment or structures. 53 54 Chair Lowe opened the meeting for discussion and questions of staff 55 56 The Board had a short discussion of the request. 57 58 William Studdard, representative of Hoos Architecture of 1717 Indian River Blvd., Vero Beach was 59 sworn in and gave reasoning for the request. 60 61 Chair Lowe opened the public hearing 62 No one spoke 63 Chair Lowe closed the public hearing 64 65 Chair Lowe returned to the Board for discuss and/or motion. 66 Mr. Harris made a motion: After considering the testimony presented during the public 67 hearing, including staff comments, and the Standards of Review as set forth in Section 10.01.02 68 of the St. Lucie County Land Development Code, I hereby move that the Board of Adjustment 69 approve the petition of Stephen Basile for a variance from the provisions of Section 4.01.04 of 70 the St. Lucie County Land Development Code to allow for a 3.5 foot height variance for a new 71 single family residence in the HIRD zoning district because no one objected to the variance, 72 the nearest home owner is on the other side of the Conservation Public land and no additional 73 traffic.
