setback requirements in the Harbour Ridge, Royal Fern Village Planned Unit Development 40
(PUD) for a proposed screen enclosure to encroach up to 2 feet into the minimum 20 foot 41

required rear yard building setback. The subject property is located at 2018 Royal Fern Court 42
in the PUD zoning district. Staff report by Jeff Johnson was presented by Linda Pendarvis. 43

Linda Pendarvis, Comprehensive Planning Coordinator stated Mickey Hernandez is requesting a 45
variance from the minimum building setback requirements as noted in the Harbour Ridge, Royal Fern 46
Village Planned Unit Development (PUD) final site plan for a proposed screen enclosure to be located 47
in the rear of an existing one-story single family residence that will encroach up to 2 feet into the 48
minimum 20 foot required rear yard setback. The applicant applied for a building permit on May 9, 49
2017 that was approved. Their next door neighbor along with the Harbour Ridge Home Owners 50
Association support the variance request. 51

Brad Curry of Engineering Design & Construction, the agent was sworn in and gave reasons for the 57
request. 58

Vice-Chair Harris returned to the Board for discuss and/or motion. 64
Chief Foxx made a motion: After considering the testimony presented during the public 65
hearing, including staff comments, and the Standards of Review as set forth in Section 10.01.02 66
of the St. Lucie County Land Development Code, I hereby move that the Board of Adjustment 67
approve the petition of Mickey Hernandez from the minimum building setback requirements 68
in the Harbour Ridge Royal Fern Village PUD subdivision for a proposed screen enclosure to 69
encroach a maximum of 2 feet into the required minimum 20 foot rear yard setback for the 70
subject property because the variance is the minimum variance that will make possible the 71
reasonable use of land because the PUD does not have setbacks for accessory structures; the 72
architectural review board for Harbour Ridge home owners association support the variance 73
request and the variance does not impair or otherwise injure other property or improvements 74
in the area in which the subject property is located. Mr. Jacquin seconded the motion. 75
