Recording Secretary 25 26 Staff introduced themselves 27 28 ANNOUNCEMENTS 29 None 30 31 AGENDA ITEM #1 – MINUTES OF August 23, 2017 32 Vice Chair Harris motioned approval of the minutes as written. 33 Mr. Jacquin seconded and the motion carried unanimously. 34 35 AGENDA ITEM #2 – Public Comments 36 None 37 38 AGENDA ITEM #3–Petition of Richard Friedrich for a variance to allow for the construction of 39 a single family residence that will exceed the 30% maximum lot coverage by buildings by no 40 Page 2 of 3 APPROVED BOA Minutes September 27, 2017 more than 5% as required per Land Development Code, Section 7.04.01(A)-Lot coverage in the 41 RS-4 residential, single family – 4 zoning district. Staff report by Jeff Johnson. 42 43 Jeff Johnson, Senior Planner stated applicant Richard Friedrich is requesting a variance to construct 44 a two story single family residence that will exceed the 30% maximum lot coverage by buildings by no 45 more that 5% as required per Land Development Code Section, 7.04.01(A) – Lot coverage in the RS-46 4, Residential, Single Family – 4 zoning district. Staff recommends denial of the variance as it does 47 not arise from conditions that are unique and peculiar from the land and physical surroundings and 48 are created by actions of the property owner. 49 50 Chair Lowe opened the meeting for discussion and questions of staff 51 52 The Board asked staff if there was a Home Owners Association (HOA) and the answer was no; asked 53 about the setbacks 54 55 Mr. Friedrich, the applicant was sworn in and explained the reasons for the requested variance. 56 57 DISCLOSURE: 58 Mr. Jacquin stated he knows a few residents that live in the area and were contacted by them to 59 discuss this project. Mr. Chandler, an FPL employee was in favor of this partition; Mr. Yancy who lives 60 next door was also in favor. 61 62 Chair Lowe disclosed that he spoke to Senator Pruitt about this petition yesterday by phone and he is 63 against it. 64 65 Chair Lowe opened the public hearing 66 Ken Pruitt was sworn in representing the neighbor living at 256 Marina Drive, Alberto Moragues who 67 is against this petition gave reasons for being against it. 68 Chair Lowe closed the public hearing 69 70 Chair Lowe returned to the Board for discuss and/or motion. 71 Mr. Jacquin made a motion: After considering the testimony presented during the public 72 hearing, including staff comments, and the Standards of Review as set forth in Section 10.01.02 73 of the St. Lucie County Land Development Code, I hereby move that the Board of Adjustment 74 approve the petition of Richard Friedrich to construct a single family residence that will exceed 75 the 30% maximum lot coverage by buildings in the RS-4 zoning district by no more than 5% on 76 the subject property because it will not impact traffic or decrease the value of the 77 neighborhood.
