AGENDA ITEM #3–Petition of Hugh & Marianna O’Boyle for a variance from the minimum 39
building setback requirements in the Harbour Ridge, Harbor Village Planned Unit Development 40
(PUD) to remedy an existing encroachment in the rear yard setback. The existing pool deck & 41

screen enclosure has an encroachment via the corner of the pool deck approx. 2.9’ into the 42
required 30’ rear yard setback. The 0.61 acre property is located at 13413 NW Wax Myrtle Trail 43
in the PUD zoning district. Staff report by Bethany Grubbs. 44

Bethany Grubbs, Planner stated applicant Hugh O’Boyle is requesting a variance from the minimum 46
building setback requirements in the Harbour Ridge, Harbour Village Planned Unit Development to 47
remedy an existing encroachment in the rear yard setback. The existing pool deck and screen 48
enclosure has an encroachment via the corner of the pool deck approx. 2.9 foot into the required 30 49
foot rear yard setback. Staff recommends approval as the variance results in a hardship that is unique 50
to the property owner as the circumstances involved in the placement of the pool deck and screen 51
enclosure on the property were beyond the control of the property owner, 52

Chair Lowe opened the meeting for discussion and questions of staff 54

The Board asked staff about the public hearing notice form possibly having a discrepancy regarding 56
the property location on one side and a different location on the back of the form. Staff checked and 57
the issue was resolved as not being a discrepancy. 58

Mike McCarty was sworn in representing the applicant and explained the need for the variance and 61
stated the HOA approved. 62

Chair Lowe returned to the Board for discuss and/or motion. 65
Vice Chair Harris made a motion: After considering the testimony presented during the public 66
hearing, including staff comments, and the Standards of Review as set forth in Section 10.01.02 67
of the St. Lucie County Land Development Code, I hereby move that the Board of Adjustment 68
approve the petition of Hugh and Marianne O’Boyle for a variance from the minimum building 69
setback requirements in the Harbour Ridge, Harbour Village PUD for an existing pool deck and 70
screen enclosure to encroach 2.9 feet into the required minimum 30 foot rear yard setback for 71
the property located at 13413 NW Wax Myrtle Trail because there were no oral objections made 72
from the public; the variance does not impair or otherwise injure other property values or 73
improvements in the area and the request received approval from the Harbour Ridge Property 74
Owner’s Association. Chief Foxx seconded the motion. 75

Bonnie Landry, Planning Manager suggested to combine the November/December BOA meetings so 84
there would not be any conflict with the holidays. The next BOA meeting will be Dec. 13th. 85
