THIS INDENTURE, made this L$ILL day of December, 2019, between Waterston
Holding Investments, LLC, a Florida Limited Liability Company f/k/a Waterstone
Builders, LLC, a Florida Limited Liability Company, having an address at 1698 West
Hibiscus Boulevard, Suite A, Melbourne, FL 32901 (hereinafter called the "Grantor"), and
K. Hovnanian Aspire At Waterston, LLC, a Florida Limited Liability Company, having
an address at 3601 Quantum Boulevard, Boynton Beach, FL 33426 (hereinafter called the
"Grantee").
(Whenever used herein the terms "grantor" and "grantee" shall include singular and
plural, heirs, legal representatives and assigns of individuals, and the successors and
assigns of corporations, wherever the context so admits or requires.)
WITNESSETH:
That Grantor, for and in consideration of the sum of Ten Dollars ($10.00), and
other good and valuable consideration, to Grantor in hand paid by Grantee, receipt of
which is hereby acknowledged, has granted, bargained and sold to Grantee, and
Grantee's heirs, successors and assigns forever, the following described land, situate,
lying and being in St. Lucie County, Florida, to wit:
Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 25, 26,
27, 28, 29, 30, 31, 32, 33, 34, 35, 36, 37, 38, 39, 40, 41, 42, 43, 44, 45, 46, 47, 48, 49, 50,
51, 52, 53, 54, 55, 56, 57, 58 and 59, BLOCK 3, WATERSTONE - PHASE ONE,
according to the Plat thereof, as recorded in Plat Book 52, at Page 35, of the Public Records
of St. Lucie County, Florida.
SUBJECT TO:
I. Taxes and assessments for the year 2020 and subsequent years.
2. Plat of WATERSTONE - PHASE ONE, as recorded in Plat Book 52, at
Page 35, of the Public Records of St. Lucie County, Florida.
3. Master Declaration Of Covenants, Conditions, And Restrictions, recorded
on May 2, 2006 in Official Records Book 2550, at Page 2128, of the Public
Records of St. Lucie County, Florida, as amended.
4. Existing zoning, restrictions, prohibitions and other similar requirements
imposed by governmental authority.
5. Restrictions, agreements, reservations, dedications, easements, and
limitations, and all other matters of record, but the provision shall not
operate to reimpose the same.
TOGETHER with all the tenements, hereditaments and appurtenances thereof
belonging or in otherwise appertaining.
TO HAVE AND TO HOLD, the same in fee simple forever.
AND the Grantor does hereby covenant with Grantee that the Grantor is lawfully
seized of said land in fee simple; that the Grantor has good right and lawful authority to
sell and convey the land; that the Grantor fully warrants the title to said land and will
defend the same against the lawful claims of all persons whomsoever; and that said land
is free of all encumbrances, except taxes accruing subsequent to December 31, 2019, and
as otherwise set forth in this Warranty Deed.
IN WITNESS WHEREOF, Grantor has hereunto set Grantor's hand and seal the
day and year first above written.
