HomeMy WebLinkAboutResolution 04-004t,li�sti RESOLUTION 04-004 FILE NO.: MJSP-03-011 i A RESOLUTION GRANTING MAJOR SITE PLAN s APPROVAL FOR THE PROJECT KNOWN AS ATLANTIC 6 TRUSS COMPANY 7 j s WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the 9 testimony and evidence, including but not limited to the staff report, has made the following 10 determinations: 11 12 1. Atlantic Truss Company. Ltd., has applied for major site plan approval for a truss 13 manufacturing facility to be known as Atlantic Truss Company consisting of a 63,750 14 square foot manufacturing building and a 5,000 square foot office for a total of 15 68,750 square feet of space for property located at the east side of North Kings 16 Highway, approximately'/a mile south of St. Lucie Boulevard in the IL (Industrial, 17 Light) Zoning District for the property described in Part B. 1e 19 2. The Development Review Committee has reviewed the site plan for the proposed 20 project and found itto meet minimum technical requirements of the St. Lucie County 21 Land Development Code and to be consistent with the future land use maps from 22 the St. Lucie County Comprehensive Plan. 23 . 24 3. The proposed project is consistent with the general purpose, goals, objectives, and 25 standards of the St. Lucie County Land Development Code, the St, Lucie County 26 Comprehensive Plan, and the Code of Ordinances of St. Lucie County. 27 28 4. The proposed projectwill not have an undue adverse effect on adjacent property, the 29 character of the neighborhood, traffic conditions, parking, utility facilities, or other 30 matters affecting the public health, safety, and general welfare. 31 32 5. All reasonable steps have been taken to minimize any adverse effect of the 33 proposed project on the immediate vicinity through building design, site design, 34 landscaping and screening. 35 36 6. The proposed project will be constructed, arranged and operated so as not to 37 interfere with the development and use of neighboring property, in accordance with 38 applicable district regulations. 39 40 7. The proposed project will be served by adequate public facilities and services. 41 42 8. Pursuant to Section 11.02.05 of the St. Lucie County Land Development Code, the site plan forthe project known as Atlantic Truss Company, is hereby approved as shown on the site plan drawings forthe project prepared by Mosby & Associates, Inc., dated September 11, 2003, and date stamped received by the St. Lucie County Community Development Director on November 26, 2003, for the property described below, subject to the following condition; Prior to the issuance of the Building Permit for the proposed truss manufacturing project, the petitioner, his successors or assigns, shall conveyto St. Lucie County, in manner and form acceptable to the St. Lucie County Attorney, right-of-wayforthe futurewidening of Kings Highway. Said right-of-way dedication shall consistof the west 150 feet of the subject property on the northern boundary to taper to the west 127 feet at the southern boundary of the subject property. To the extent permitted under the County's Code and Compiled Laws, any such dedication may be considered eligible for Road Impact Fee Credits. B. The property on which this Site Plan is being granted is described as follows: THE NORTH 452.50 FEET OF THE SOUTHWEST 114 OF THE NORTHWEST 114 - LESS THE WEST 74.00 FEET FOR ROAD AND CANAL RIGHT-OF-WAY, LYING IN SECTION 36, TOWNSHIP 34 SOUTH, RANGE 39 EAST, ST. LUCIE COUNTY, FLORIDA. CONTAINING 13.05 ACRES, MORE OR LESS. (Tax ID#: 1336-231-0001-00012) (Location: East side of North Kings Highway, approximately % mile south of St. Lucie Boulevard) C. The approvals and authorizations granted by this Resolution forthe purpose of obtaining building permits on this property and the approvals granted under the resolution shall remain effective for the remaining validity period of the Atlantic Truss major site plan. D. The Final Site Plan approval granted under this resolution is specifically conditioned to the requirement that the petitioner, Atlantic Truss Company, Ltd., including any successors in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal regulatory authorities, including but not limited to; the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part B. E. A copy of this resolution shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Community Development Director. F. The revised certificate of capacity, attached as Exhibit A. shall be valid for the same period as this order. If this order expires orotherwise terminates, the certificate of capacity shall automatically terminate. A copy of this Order shall be mailed, return receipt requested to the developer and agent of record as identified on the site plan applications. H. A copy of this Order shall be attached to the site plan drawings described in Section A, which plan shall be on file with the St. Lucie County Community Development Director. I.
