A RESOLUTION APPROVING A VARIANCE FOR
CERTAIN PROPERTY LOCATED IN ST. LUCIE COUNTY, FLORIDA
WHEREAS, the Board of Adjustment of St. Lucie County, Florida, based on the testimony and evidence, including, but not limited to the staff report, has made the following determinations:
Petition of George and Elizabeth Gerner for a variance from the provisions of Section 7.04.01 (Table 7-10) Lot Size and Dimensional Requirements of the St. Lucie County Land Development
Code to allow for the construction of a pool to encroach into the required minimum 15-foot rear yard setback by no more than 3.0 feet, providing a total rear yard setback of 12 feet
to the water’s edge for the swimming pool, within the RS-4 (Residential, Single-Family – 4 du/ac) Zoning District.
On August 26, 2020, this Board held a public hearing on the petition, after publishing a notice of such hearing in the St. Lucie News Tribune, installing a sign on property and notifying
by mail all owners of property within 500 feet of the subject property.
After consideration of the testimony presented during the public hearing, including staff comments, exhibits, and the standards of review for granting variances set out in Section 10.01.02,
St. Lucie County Land Development Code, the Board of Adjustment has made the following determinations:
The requested variance meets the requirements set forth in St. Lucie County Land Development Code Section 10.01.02, and are not in conflict with the Goals, Objectives, and Policies of
the St. Lucie County Comprehensive Plan because:
Granting of the variance will not impair or injure other property or improvements in the neighborhood, nor diminish or impair property values within the neighborhood;
The variance is not opposed to the general spirit and intent of this Code or the St. Lucie County Comprehensive Plan;
The presence of additional land between the restored seawall and platted property line provide conditions that are unique and peculiar to the land, structures, and buildings involved;
and
The proposed pool and deck are to be constructed at-grade, and the applicant is not proposing a screen enclosure or other vertical fixture above the pool.
NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of St. Lucie County, Florida:
The petition of George and Elizabeth Gerner for a variance to allow for the construction of a pool to encroach into the required minimum 15-foot rear yard setback by no more than 3.0
feet, providing a total rear yard setback of 12 feet to the water’s edge for the swimming pool, located within the RS-4 (Residential, Single-Family – 4 du/ac) Zoning District, as
depicted on the attached location map as Exhibit “A”, the attached boundary survey as Exhibit “B”, and more specifically described below:
Legal Description: Coral Cove Beach – Section One – BLK 5 Lot 26 (OR 3822-2918)
Address: 253 Marina Drive, Fort Pierce, FL 34949
Parcel ID No.: 1425-701-0139-000-3
Based on the evidence presented, the requested variance for a 3.0-foot encroachment into the rear yard setback specific to the water’s edge for the swimming pool is approved.
This Order shall become effective upon the date indicated below. An appeal from the Board of Adjustment’s action must be filed with the courts of the State of Florida within thirty (30)
days following the rendition of the decision of this order in accordance with Section 10.01.07, of the St. Lucie County Land Development Code.
This Order shall be recorded in the public records of St. Lucie County.
