8. Abnormal Conditions. CONTRACTOR is not responsible. for any e)ddng'igegal condbons such as non -permitted or non -
code -compliant conditions . If any public body;municipal or . qbvemm I ental authority,utift'and/or. inspector (collectively

10. Removal of Material and Debris. CONTRACTOR'agrees to keep.the work premises and adjoining ways flee orwaste
material. and rubbish. CONTRACTOR further agrees to remove all'such waste material and rubbish on termination of the
project, togetherwilh all the tools, equipment,.machinery.and-surplus materials. CONTRACTOR -agrees, on terrninaGrig

11. Delays. CONTRACTOR shall not be responsible for delays caused by any of the following: failure of a Public

control or esc mk ads of n6glo or omission by OWNER or OWNERS employees or agents; aridlor delays caused by.

materials, failure to properly maintain or repair the equipment, weather; shade or any other act beyond _

terminate this contract and demand payment for all workperformed; materials ordered and/or supplied and any other
loss sustained in accordance with Florida.law
15. Sionage. During the Perm or this AGREEMENT, CONTRACTOR may erect one temporary sign showing Its name,
service "mark, trade name or other commerOW. name,' identifying'CONTRACTOR as p6dbrming services at the
Properly. The sign will be,appropriate in doppararrce.-style and size, and will con6omi toanyapplicable federal, state and
local laws:including HOArequ'iremertts.
16. Owner's 116mesentations and Warranties; OWNER represents and warrants the following:. .
a. The Roof. The proposed roof -area is stnfcturally:sourid and,requtres no further engineering and/or
review in odder to obtain a permit from a Public Body in order to'cornplete the:Work- .
b. The Electrical System: Thw existing electrical systems located on the Properly:.() is adequate to carry the
load imposed:for the Work (the "Electrical System"); (ii) is code c&npltant:; :(Iii) will accept solar
installation without addition of.ne* equipment that may be beyond code'requirements for the
Installation of a new solar. PV system. (NEC)..
OWNER understands that.CONTRACTOR is relying entirely on the information supplied to CONTRACTOR
and OWNER warrants and represents that, all such information is entirely accurate and truthful. If any
investigation' is initiated or -if any.actton is brought byany individual, company or entity whatsoever regarding
any of the OWNER'S Representations:'and Warranties against CONTRACTOR, then OWNER agrees to .
cooperate fully in any such Investigation or action and shall provide all relevant supporting documentation.
Further, OWNER shall defend 'and inderrintfy CONTRACTOR and their agents and employees; from and
against any -and all, claims, _damages; losses, and expenses, including reasonable attorneys' fees relating to
OWNER'S Representations and Warranties.
17. DISCLAIMERS. CONTRACTOR CANNOT GUARANTEE THE PERFORMANCE OF THE SOLAR ELECTRIC
SYSTEM DUE TO VARIANCES IN WEATHER OVER TIME. ALL PERFORMANCE IS BASED ON:NREIL
HISTORICALDATAAND IS SUBJECTTO WEATHER -CONTRACTOR CANNOT GUARANTEE THE ACTUAL
RESALE VALUE ORADDED VALUE TO A HOME BASED ON THE INSTALLATION'OF SOLAR CONTRACTOR
CANNOTACCURATELY GAUGE THE CURRENT HEALTH OF ANY LOCAL UTILITYTRANSFORMER;
CONTRACTOR IS NOT RESPONSIBLE FORANY DAMAGE TOANI' LOCAL• U nLITYTRANSFORMER THAT MAY
