An OSHA "competent person" is defined as "one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them". [29 CFR 1926.32(f)]. By way of training and/or experience, a competent person is knowledgeable of applicable standards, is capable of identifying workplace hazards relating to the specific operation, and has the authority to correct them. Some standards add additional specific requirements which must be met by the competent person. 2017 Trene All nghts reserved Revised B-12-10 10 of 10 rA WE Exhibit A Subcontractor's Scope of Work Subcontractor shall perform the following Scope of Work: Scope of Work Provide labor, material, rigging, crane and equipment as required to provide a complete and functional installation of (1) new chiller and (3) new Chilled water pumps per project drawings provided by Sales O'Brien. • Install (1) new chiller provided by Trane. • Dispose of old equipment per EPA standards • Provide alterations to the chiller yard chain link fence as needed to allow for the installation of the new Chiller • Modify supply and return CHW lines & pipe stands as needed to accommodate the new piping connections. • Install customer supplied chilled water control valvesiflow meters. • Replace (2) CHW isolation valves for the chiller. • Re -insulate all piping as required. • Remove 3 Existing Pumps and replace with new pumps provided by Trane. • Modify existing piping to accommodate new pumps a needed. • Set and fill customer supplied inertia bases with concrete. (customer responsible for spring isolator selection) • Install new Isolation valves, multipurpose valves and suction diffusers as required. • Provide pump alignment as required. 02017 Tmoo All dghta reserved ReOuld 8.12-10 2 of 10 TAMAW Overhead & Profit Fee Schedule Exhibit B Overhead & Profit Fee Schedule For Change Orders The fee allowed to Subcontractor for overhead and profit shall be determined as set forth in this Schedule. Any Subcontractor's fee for overhead and profit shall be included in the Change order as a mutually acceptable fixed fee or, if no agreement is reached, then based on the following percentages, as applicable to the types of actual costs listed: A fee of 15% shall be paid for the following actual costs: • Payroll costs for employees directly employed by Subcontractor in the performance of the Work under job classification schedules agreed upon by Subcontractor and Contractor. Payroll casts for a part-time employee is apportioned on the basis of such employee's time spend on the Work. Payroll costs include the following: salaries and wages, fringe benefits, including social security contributions, unemployment, excise and payroll taxes, workers' compensation, health and retirement benefits, sick leave, vacation and holiday pay applicable thereto. Unless otherwise agreed by Contractor, all payroll costs are for straight time (regular working hours, excluding Saturday, Sunday, and holidays). • Cost of all materials and equipment furnished and incorporated into the Work, including reasonable transportation and storage A fee of 5% shall be paid for the following actual costs: • Payments made by Subcontractor to its subcontractors for Work performed or furnished by such sub - subcontractors. Competitive bids from sub -subcontractors acceptable to Contractor and Subcontractor shall be obtained if required by Contractor. If any sub -subcontractor is to be paid on the basis of the actual cost of the Work plus a fee, the sub -subcontractor's cost of Work and applicable fee shall be determined in the same manner as provided by this Schedule.
