HomeMy WebLinkAboutDOC100720-003PDS ORDER 2020-065 File No.: SPMn-7202025795 AN ORDER GRANTING A MINOR ADJUSTMENT TO THE MINOR SITE PLAN FOR THE PROJECT KNOWN AS UNITED TELEPORTS - SES (FKA SKY LATIN AMERICA) LOCATED AT 10161 RANGE LINE ROAD, PORT ST. LUCIE WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request for a Minor Adjustment to the Minor Site Plan for the project known as United Teleports - SES, the recommendation of the Development Review Committee, and has made the following determinations: 1. Michael Sanchez, representing UT Land Development Company, LLC, presented a petition for a Minor Adjustment to the Minor Site Plan known as United Teleports - SES to construct an 85'x 88' elevated steel structure platform, construction of a 417 square foot mezzanine addition, incorporate the existing ground -mounted satellite antennas and associated foundations, along with minor revisions to the parking and landscaping layout. 2. The Development Review Committee reviewed the proposed Site Plan for the project and found it meets the technical requirements of the St. Lucie County Land Development Code and has satisfied the standards of review set forth in Section 11.02.07, Standards for Site Plan Review, of the St. Lucie County Land Development Code. 3. Planning Staff has performed a detailed analysis of the project and determined it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is located in the Planning and Development Services Department memorandum titled United Teleports - SES - MinorAdjustment to Minor Site Plan (SPMn- 7202025795), dated October 5, 2020. 4. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 5. All reasonable steps have been taken to minimize any adverse effects of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. NOW, THEREFORE, BE IT ORDERED BY THE PLANNING AND DEVELOPMENT SERVICES DIRECTOR OF ST. LUCIE COUNTY, FLORIDA: A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the Minor Adjustment to the Minor Site Plan is hereby approved as shown on the site plan drawings prepared by Brent A. Wood, Architecture, LLC, date stamped by the Planning & Development Services Department on September 21, 2020, subject to the following conditions: SPMn-7202025795 PDS 2020-065 Page 1 of 5 1) Prior to the issuance of a Site Development Permit, the applicant shall provide an updated plan identifying the existing Right -of -Way width for Range Line Road and the setback distance for each gate from the western Right -of -Way line. 2) The eastern rolling security gate, located along the Range Line Road right-of-way, must remain open during normal business hours to allow for adequate vehicular stacking when entering the facility. 3) Prior to Certificate of Occupancy/Completion for the proposed elevation structure, the applicant shall apply for an after -the -fact permit(s) for all unpermitted antenna, the pump house, and water storage tank. 4) Within 60 days of issuance of a vegetation removal permit or exemption, all Category I invasive species shall be eradicated from the site. B. The property on which this Minor Adjustment to the Minor Site Plan is being granted is described as follows: LEGAL DESCRIPTION: COMMENCE AT THE NORTHEAST CORNER OF SECTION 1, TOWNSHIP 37 SOUTH, RANGE 38 EAST, ST. LUCIE COUNTY FLORIDA; THENCE RUN SOUTH 00000'54" WEST, ALONG THE RANGE LINE, A DISTANCE OF 4,176.86 FEET, TO THE POINT OF BEGINNING; THENCE CONTINUE ALONG SAID RANGE LINE A DISTANCE OF 250.00 FEET; THENCE RUN NORTH 89059"06" WEST, A DISTANCE OF 660.00 FEET; THENCE RUN 00° 00'54" EAST, PARALLEL WITH AFORESAID RANGE LINE, A DISTANCE OF 250.00 FEET; THENCE RUN SOUTH 89059'06" EAST. A DISTANCE OF 660.00 FEET TO THE POINT OF BEGINNING. Parcel Identification Number: 4201-113-0001-030-2 Address: 10161 Range Line Road, Port St. Lucie, FL 34987 C. This Minor Adjustment to the Minor Site Plan for United Teleports- SES shall expirewithin twenty-four (24) months of the effective date of this Order, unless a building permit is issued or an extension is granted in accordance with Section 11.02.06, St. Lucie County Land Development Code. D. The developeris advised as partof this Minor Adjustment approval United Teleports -SES including any successors in interest, the developer shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and South Florida Water Management District, and the St. Lucie County Environmental Resources, Public Works and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this approval by the County does not in any way SPMn-7202025795 PDS 2020-065 Page 2 of 5 create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developerfails to obtain requisite approvals orfulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. A copy of this Order shall be attached to the site plan drawings described in Part A, which then shall be placed on file with the St. Lucie County Planning and Development Services Department and mailed to the developer and agent of record as identified on the Site Plan application. The conditions set forth in Part A are an integral non -severable part of the Site Plan approval granted by this Order. If any condition set forth in Part A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this Order shall become null and void. G. A Certificate of Capacity, a copy of which is attached hereto as Exhibit B and made a part hereof the Order, was granted by the Planning and Development Services Department Director, which shall remain valid for the period of Site Plan approval.
