This Warranty Deed made this day of ��2004 between ROAR-BHD, LLC, a Flori
company whose post office address is P.O. Box 32335, Palm Beach Gardens, FL 33420,' grantor, and EUGENE W.
NEWMAN and LYNDA NEWMAN, husband and wife whose post office address is 218 Barcelona Drive, Jupiter, FL
33458, grantee:
(Whenever used herein the terms "grantor" and "grantee" include all the parties to this instrument and the heirs, legal representatives, and assigns of
individuals, and the successors and assigns of corporations, trusts and trustees)
Witnesseth, that said grantor, for and in consideration of the sum of TEN AND NO/100 DOLLARS (S10.00) and other
good and valuable considerations to said grantor in hand paid by said grantee, the receipt whereof is hereby acknowledged,
has granted, bargained, and sold to the said grantee; and grantee's heirs and assigns forever, the following described land,
situate, lying and being in Saint Lucie County Florida to -wit:
Lot 42 of WATERSONG P.U.D. PLAT NO. ONE, as recorded in Plat Book 42, Page 34, Public
Records of St. Lucie County, Florida.

It is a material provision of this Deed and a significant inducement for Grantor entering into the
Purchase Agreement that the Grantee hereby irrevocably and unequivocally agrees to enter into a
construction contract with Grantor for construction of a single-family home upon the Property,
planned to be the Oceanfront A model at an estimated cost of $875,000; and to commence (or have
commenced) within the construction timelines required by the Ginn Real Estate Company or three
years, whichever is later. Commenctnent of construction, as referred to herein, shall mean -the
substantial completion of the concrete'slab improvements for a residential dwelling unit upon the
Property.
In the. event Grantee does not enter into a Construction Contract with Grantor within six (6) months
of the Lot'closing and/or commence construction on the Property within three (3) years from the date
of the lot closing (defined as the first date when the lot could be constructed thereon in accordance
with the rules and regulations of the building department where the lot is situated), and continously
and diligently pursue construction to completion with the Grantor, then the Grantor may enfore the
provisions of this agreement and pursue any and all remedies available to Grantor at law and/or in
equity.
Subject to taxes for 2004 and subsequent years; covenants, conditions, restrictions, easements, reservations
and limitations of record, if any.
Together with all the tenements, hereditaments and appurtenances thereto belonging or in anywise appertaining,
To Have and to Hold, the same in fee simple forever.
And the grantor hereby covenants with said grantee that the grantor is lawfully seized of said land in fee simple; that the
grantor has good right and lawful authority to sell and convey said land; that the grantor hereby fully warrants the title to said
land and will defend the same against the lawful claims of all persons whomsoever; and that said land is free of all
encumbrances, except taxes accruing subsequent to December .31, 2003.
