buyer at completion of work upon request.

If Remeasure was not scheduled at point of sale the Measure Technicians will call you to schedule that
appointment. Homeowner listed on the deed must be present for Remeasurellf they leave a message, please Rapid
Respond to avoid delays as they set their schedule geographically and the remeasure and layout are required to submit
for Permitting and HOA. Nothing can start until we have Remeasurel There are Permit Application and Notice of
Commencement documents, which the homeowner on the deed must authorize at Remeasure and product questions
which must be answered at Remeasure. Homeowners on the deed not being present for Remeasure will cause these
documents to be slowly mailed back and forth, losing time, and is a chief cause of additional time being added to

If your project has a Homeowner's Association our HOA Department will need you to obtain your HOA's specific ARC
Form to submit for approval and the most accurate contact information for your HOA. Please email the ARC form to

Paradise Exteriors Production Department will be calling to schedule a date for your project's installation. If they leave a
message, please Rapid Respond as these install schedules fill in quickly. Homeowner on contract must be present when
our crews arrive at your home to begin work. This is to clearly provide any special instructions relating to the project or
your property. Homeowner not returning calls for install date and Homeowner on contract not being present when our
crews arrive causing them to return to warehouse are chief reasons for additional time being added to estimated time

Paradise Exteriors will dispatch a technician to meet the Building Department Inspector at your home for inspection. If
they leave a message, please Rapid Respond as these inspection schedules fill in quickly. Homeowner on contract must
be present for this meeting with your building department. Homeowner failing to attend scheduled inspection date they
chose would be costly and cause additional time to be added to estimated time frame.

Florida's Construction
ACCORDING TO FLORIDA'S CONSTRUCTION LIEN LAW (SECTIONS 713.001- 713.37, FLORIDA STATUTES), THOSE
WHO WORK ON YOUR PROPERTY OR PROVIDE MATERIALS AND SERVICES AND ARE NOT PAID IN FULL HAVE A
RIGHT TO ENFORCE THEIR CLAIM FOR PAYMENT AGAINST YOUR PROPERTY. THIS CLAIM IS KNOWN AS A
CONSTRUCTION LIEN. IF YOUR CONTRACTOR OR A SUBCONTRACTOR FAILS TO PAY SUBCONTRACTORS, SUB -
SUBCONTRACTORS, OR MATERIAL SUPPLIERS, THOSE PEOPLE WHO ARE OWED MONEY MAY LOOK TO YOUR
PROPERTY FOR PAYMENT, EVEN IF YOU HAVE ALREADY PAID YOUR CONTRACTOR IN FULL. IF YOU FAIL TO PAY
YOUR CONTRACTOR, YOUR CONTRACTOR MAY ALSO HAVE A LIEN ON YOUR PROPERTY. THIS MEANS IF A LIEN IS
FILED YOUR PROPERTY COULD BE SOLD AGAINST YOUR WILL TO PAY FOR LABOR, MATERIALS, OR OTHER
SERVICES THAT YOUR CONTRACTOR OR A SUBCONTRACTOR MAY HAVE FAILED TO PAY. TO PROTECT YOURSELF,
YOU SHOULD STIPULATE IN THIS CONTRACT THAT BEFORE ANY PAYMENT IS MADE, YOUR CONTRACTOR IS
REQUIRED TO PROVIDE YOU WITH A WRITTEN RELEASE OF LIEN FROM ANY PERSON OR COMPANY THAT HAS
PROVIDED TO YOU A "NOTICE TO OWNER." FLORIDA'S CONSTRUCTION LIEN LAW IS COMPLEX, AND IT IS
RECOMMENDED THAT YOU CONSULT AN ATTORNEY.
Additional Terms and Conditions of this Agreement
1. All work shall be completed in a workmanlike manner according to Florida Building Codes and Industry Standards and
practices. Paradise Exteriors will haul away all job- related debris. Paradise Exteriors provides complimentary labor for
any replacement part or product warrantied and supplied by the manufacturer for as long as original purchaser owns the
home. All manufacturer warranties shall be provided to Buyer upon request at completion of work and when the job is
fully paid for. Start of installation approximately 6-12 week(s) from after securing a permit, HOA, finance
approval. Unforeseen engineering and or elevation expenses not included into this agreement. Products outside of our
catalog and sizing can add 6-12 weeks to the estimated time frame.
2. Buyer agrees to pay the agreed upon Commencement payment in full to the installation supervisor,' before work
begins. Buyer also agrees to pay any agreed upon Balances Due in full at completion to the; installation supervisor on the
same day installation of all windows/doors is completed. Completion payment, or portions of, are not permitted to be
held for stucco, service, etc. unless authorized by Paradise Exteriors. Any balances held until completion or final
inspection must be authorized by Paradise Exteriors Management and written into this Agreement. Paradise Exteriors
accepts checks as a form of final payment. Credit Card payments are subject to a i3% convenience fee. Returned
payments/checks drawn on accounts with non -sufficient funds are subject to up to a $50.00 penalty. If Paradise
Exteriors arranged financing and secured the necessary approvals in advance, Buyer will berequired 'to sign a
completion form notifying the lender that the work was completed.
3. Buyer agrees that all spaces in the structure in which work will be performed have been properly permitted and that
Buyer is responsible for informing Paradise Exteriors of any unpermitted spaces in the structure prior to entering into
this Agreement. Buyer agrees that their having no prior knowledge of an unpermitted space for which they are
requesting work to be performed does not relieve them of their agreed to and scheduled payment/completion form
obligations. Paradise Exteriors is not responsible for discovering unpermitted spaces, any work performed in an
undisclosed unpermitted space, nor does it have any obligation to help to cure/resolve prior unpermitted work.

5. Buyer agrees to have all valuables, firearms, collectibles, items of sentiment, etc. placed in a secure location prior to
any Paradise Exteriors representatives entering their home. Paradise Exteriors is not responsible for missing/damaged
aforementioned items.
6. This is considered to be a cash agreement. Third parties may offer financing as a convenience to customers, but
Paradise Exteriors is not a lender and has no say in the final decision rendered by a lender regarding financing., Buyer
agrees that finance terms are pending approval by the lender. Buyer agrees that should their requested finance terms at
the point of sale be denied by a lender Paradise Exteriors has the authority to seek out alternative lenders to secure
equal or better terms with regard to interest rate and payment. All deposits and credit applications will be processed
immediately. Delayed processing of these items maybe approved by Management only at the point of sale and those
terms must be written into the agreement.

7. Paradise Exteriors reserves the right to cancel this Agreement at any time prior to ordering product and return any
deposits in cases, including but not limited to, where a sales representative may have entered into an agreement that is
unauthorized in terms of pricing or Paradise Exteriors is not able to perform the scope of the work contracted.
8. It is Buyer's responsibility, not Paradise Exteriors, to move/remove anything impeding the installation of products
unless otherwise stated in this Agreement. Buyer agrees it is their responsibility: to remove/reinstall window treatments,
to reconnect security system components, to remove/reinstall/haul off shutters, shutter tracking, or security bars, to
move furnishings and/or hangings on interior or exterior walls away from windows/doors. Should anything impeding the
installation be present when Paradise Technicians arrive to begin the project, Buyer agrees to pay Paradise Exteriors a
fee of $50.00 per opening to clear the impediment. Buyer agrees that Paradise Exteriors will not be held liable for any
property damage incurred resulting from clearing away the impediments to the installation.
9. Paradise Exteriors is responsible for repairing stucco/drywall damaged as a direct result of the installation process.
Paradise Exteriors is not responsible for painting of repaired stucco/drywall, repairing any preexisting damage, including
but not limited to insects, rotting wood, water damage, etc., discovered during the installation, or damage to any/all
flooring or underlying plumbing/electrical systems.
10. Buyer agrees that in the event of a breach of this Agreement or cancelling after the rescission period has expired, all
deposits are forfeited and Buyer is financially liable to Paradise Exteriors for the cost of any materials ordered, all out of
pocket expenses, and any loss of profit for this transaction.
11. Buyer agrees that any changes made to the products purchased must be made prior to Measure Tech arriving for the
final measure appointment. Any changes made after the arrival of Measure Tech will result in a $250 Revision Fee. Buyer
agrees that changing payment terms from cash to financing provided by Paradise Exteriors must be requested within 72
hours of original agreement date. Payment term changes requested after 72 hours from original agreement date will
incur a $500.00 processing fee along with any accompanying finance fees required by our lender. Buyer agrees to
increase deposit to 50% of total sale price when changing payment terms from finance to cash before products are
ordered and 100% payment in full if changing from finance to cash after products have been ordered.
12. Buyer agrees that any delays from issues over which Paradise Exteriors has no control causing the project to be
ordered more than 180 days after agreement execution date may be subject to pricing increases. Buyer agrees that
should they postpone the installation date beyond 21 days of Paradise Exteriors' initial request to schedule installation
they shall be subject to a $500 charge that shall increase by $30 for each additional day over 21 days. Paradise
Exteriors reserves the right to waive all/part of this charge in exchange for the Commencement payment. Any accrued
charges under this provision are in addition to, and must be paid at same time of, any balances owed.
13. Buyer agrees to set and also be present for the inspection and permit close out appointment within a 7 -day period of
Paradise Exteriors initial request to schedule the appointment. Buyer shall be subject to a $500 charge for postponing
the appointment beyond the 7 -day period. The charge shall increase by $30 for each additional day over 7 days. If Buyer
fails to be present for the scheduled appointment Buyer shall be subject to a$150 rescheduling fee. This rescheduling
fee also applies to any service appointments scheduled by Buyer for which Buyer fails to be present. A rescheduling fee
shall be waived provided Buyer provides notice at least 48 hours prior to appointment; with a limit of one waiver per
project. Accrued charges/ fees are in addition to, and must be paid at same time of, any balance owed.
14. If Buyer fails to pay in accordance with terms of this Agreement, Paradise Exteriors will take necessary legal actions
to obtain any balances due. Buyer responsible for any legal/lien fees occurred due to failure to pay in accordance with
terms of this agreement. The terms of this Agreement shall be governed by the laws of the State of Florida. Both parties
agree that venue for any legal action shall be in Palm Beach County, Florida. Buyer agrees to waive his/her right to a jury
trial should any legal action be brought under this Agreement. Amounts owing on this Agreement that are not paid in full
within 10 days of their due date shall bear interest at the rate of eighteen percent (18%) per annum and be added to
total balance owed.

15. Warranties: Manufacturers Double life of Ownership and Paradise Exteriors Accidental Glass Breakage and Life of
Ownership Labor warranties apply to the product performance of Soft Lite windows only as they are shipped from the
manufacturer. Buyer agrees to minimum service call fee of $175.00 for first hour, $75.00 for each additional hour, plus
additional parts cost for services that do not qualify as manufacturer warrantied parts. Caulking/Sealants/Films etc. are
after -market finishes and are not considered to be a factor in product performance for any product Paradise Exteriors
installs and are not covered under any warranties. Caulking/Sealant maintenance and product drainage system and
pathway maintenance are the responsibility of the homeowner. Water infiltration is not covered under the warranties for
any product Paradise Exteriors installs. Buyer agrees it is their responsibility to contact the manufacturer to determine if
water infiltration is the result of a defect in the manufacturing of the product. Cosmetic damage and misuse are not
covered under any warranties. Buyer agrees that the applicable building department's ratification of Buyer's Passed
Final Inspection concluding with the closing of Buyer's Permit shall serve as validation that all products have been
installed properly and meet Florida Building Codes and Industry Standards and Practices. Buyer agrees that product -
related consequences resulting from all types of weather including acts of God are not the responsibility of Paradise
Exteriors and that the Buyer/Buyers homeowner's insurance is responsible for curing any such consequences. All
warranties shall be void in full if payment is not received in accordance with this Agreement.
FLORIDA HOMEOWNERS CONSTRUCTION RECOVERY FUND: PAYMENT, UP TO A LIMITED AMOUNT, MAY BE AVAILABLE
FROM THE FLORIDA HOMEOWNERS' CONSTRUCTION RECOVERY FUND IF YOU LOSE MONEY ON A PROJECT
PERFORMED UNDER CONTRACT, WHERE THE LOSS RESULTS FROM SPECIFIED VIOLATIONS OF FLORIDA LAW BY A
LICENSED CONTRACTOR. FOR INFORMATION ABOUT THE RECOVERY FUND AND FILING A CLAIM, CONTACT THE
FLORIDA CONSTRUCTION INDUSTRY LICENSING BOARD AT THE FOLLOWING TELEPHONE NUMBER AND ADDRESS:

Buyer's Right To Cancel:This is a home solicitation sale, and if you do not want the goods or services, you may cancel '
this agreement by providing written notice to the seller in person, by telegram, or by mail. This notice must indicate that
you do not want the goods or services and must be delivered or postmarked before midnight of the third business days
after you sign this agreement. If you cancel this agreement, the seller may not keep all or part of any cash down
payment.
