LUCIE COUNTY, FLORIDA 7 8 WHEREAS, the Board of Adjustment of St. Lucie County, Florida, based on the testimony and 9 evidence, including, but not limited to the staff report, has made the following determinations: 10 11 1. Petition of Mickey Hernandez for a variance from the minimum building setback 1 12 requirements in the Harbour Ridge, Royal Fern Village Planned Unit Development 13 (PUD) for,a proposed screen enclosure to encroach up to two (2) feet into the minimum 14 20 foot required rear yard building setback. The subject property is located at 2018 j 15 Royal Fern Court in the PUD (Planned Unit Development)zoning district. 16 17 2. On August 23, 2017, this Board held a public hearing on the petition, after publishing a 18 notice of such hearing, installing a sign on property and notifying by mail all owners of 19 property within 500 feet of the subject property. 20 21 3. After consideration of the testimony presented during the public hearing, including staff 22 comments, exhibits, and the standards of review for granting variances set out in Section 23 10.01.02,,St. Lucie County Land Development Code, the Board of Adjustment has made 24 the following determinations: 25 26 The requested variance meets the standards of review as set forth in Section 10.01.02, 27 St. Lucie County Land Development Code and is not in conflict with the goals, 28 objectives, and policies of the St. Lucie County Comprehensive Plan, because 29 30 a) The variance is the minimum variance that will make possible the reasonable use 31 of land because the Planned Unit Development does not have setbacks for 32 accessory structures, 33 34 b) The Architectural Review Board for Harbour Ridge Home Owners Association 35 support the variance request,•and 36 37 c) The variance does not impair or otherwise injure other property or improvements 38 in the area in which the subject property is located, 39 40 NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of St. Lucie County, 41 Florida: 42 43 A.
