AN ORDER GRANTING ADMINISTRATIVE VARIANCE APPROVAL FOR
PROPERTY LOCATED AT 5607 BIRCH DRIVE, ST. LUCIE COUNTY,
FLORIDA
WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the
application for an administrative variance including but not limited to the staff report and made the
following determinations:

1. The Administrative Variance submitted by Shannon Frechette has been approved for
property located at 5607 Birch Drive Fort Pierce, Florida.
2. The Administrative Variance allows for a reduction of no less than eighty (80%) percent of
the required minimum five (5) foot side setback for driveways to four (4) feet.
3. The Administrative Variance allows for an encroachment into the required minimum side
setback by one (1) foot from the required five (5) foot side setback, for a -total side setback
of four (4) feet.
4. Staff has reviewed the Administrative Variance on the subject property and found it to
meet technical requirements of the St. Lucie County Land Development Code Section
10.01.21 and to be consistent with the Comprehensive Plan.
5. Staff has provided an analysis of the parcel's eligibility for an encroachment into the
required side setback for driveways by no LESS than EIGHTY (80%) percent pursuant to
Section 10.01.21 of the St. Lucie County Land Development Code (LDC). That analysis
is found in a memorandum dated October 13, 2020 entitled Shannon Frechette
Administrative Variance (AV-9202025837)
6. The requested encroachment will not have an undue adverse effect,on adjacent property,
does not encroach into any easements or common areas, does not conflict with other
codes, and otherwise meets the intent and purpose of the general standards for issuing a
variance pursuant to Section 10.01.21. An analysis of the general standards may be found
in a Planning and Development Services memorandum described above.
NOW, THEREFORE, BE IT ORDERED:
A. Pursuant to Land Development Code Section 10.01.21, the Shannon Frechette
Administrative Variance is hereby approved as shown on the survey by Bennett
Surveying, Inc. dated August 31, 2020, and attached herein as "Exhibit A", subject to the
following condition:
1. Prior to the issuance of a Building Permit for the detached garage, the applicant
shall submit an engineered stormwater plan to demonstrate stormwater runoff will
not adversely impact the surrounding properties.
