Several weeks ago, we were advised that the proposed sunroom that the Association wishes to construct is being evaluated as commercial, even though the sunroom will be available to residents only, and not to the general public. Specifically, on July 10, 2019, you and Bethany Grubbs, county planner, met with the sunroom project manager, Tracy Price, of The W Group, Inc. At this meeting, you expressed that the sunroom would be treated as a commercial, not residential, building. Under such a designation, certain occupancy loads, a life safety plan, and ADA requirements would apply. After being informed that the community sunroom will be used by only residents of Island Village, on July 25, 2019, you informed me that the Association will no longer have to meet ADA requirements. However, you also stated that the sunroom will be considered commercial for other building requirements mainly because of its size, although you did not indicate what specific codes or rules led to this determination.
