I’m in agreement with Linda, that the bond would be applicable if reviewing as a tower in accordance
with 7.10.23.
Although there’s no clear cut exemption list, the facility provides numerous antennas, but not via a
“tower” with the bond sought for tower removal.

The purpose of that section is as follows :
7.10.23. - Telecommunications Tower Siting.
Purpose. The purpose of this section is to establish regulations and requirements for the
siting of wireless telecommunications facilities. All new towers or antennas in the County shall
be subject to these regulations, except where specifically excluded.
Does it meet that purpose? Is the County applying the remaining requirements of 7.10.23 LDC to
the facility?

Good afternoon Katherine,
We would like your advise in the determination if a bond or security fund is required for above permit:
The permit is for antennas for United Teleports SES, a Satellite Communications Facility. See attached
staff report for the site plan adjustment, paragraph United Teleports and SES for description of the
company. Based on SLC Land Development Code chapter 7.10.24 H:
“Security Fund. Every telecommunications service provider shall establish a cash security fund, or
provide the County with an irrevocable letter of credit in the same amount, to secure the cost of
removing an antenna, antenna array, or tower that has been determined to be abandoned
under Section 7.10.23(R), in the event the owner fails to comply with the provisions of Section
7.10.23(R). The amount of the cash security fund or letter of credit to be provided as follows:
1. For each commercial telecommunication tower, cell-on-wheels, and the initial set of antenna or
antenna array ..... $25,000.00
2. For each co-located telecommunication provider's antenna or antenna array ..... 5,000.00”
We are not sure if this type of using requires a bond or security fund. Please advise.

I would recommend checking with County Attorney, Katherine Barbieri regarding whether or not this
type of use would require bonding. Did we require it on the existing dish? I really don’t think they fall
under the telecommunication tower ordinance but I can be wrong and I would imagine that Katherine
would need to defer to our outside counsel on Towers.

Good morning Kori,
I am looking for advise in above permit. The permit is to install antennas for United Teleports. Based on
LDC 7.10.23 H Security Fund a cash fund or credit letter is required for telecommunication service
providers. However, I am not sure if United Teleports would fall under this section of the Code or not
and if I should require a bond/ security fund. Please advise.
