Although there’s no clear cut exemption list, the facility provides numerous antennas, but not via a “tower” with the bond sought for tower removal. Purpose. The purpose of this section is to establish regulations and requirements for the siting of wireless telecommunications facilities. All new towers or antennas in the County shall be subject to these regulations, except where specifically excluded. Does it meet that purpose? Is the County applying the remaining requirements of 7.10.23 LDC to the facility? If you desire to discuss further, please let me know? See attached staff report for the site plan adjustment, paragraph United Teleports and SES for description of the company. Based on SLC Land Development Code chapter 7.10.24 H: “Security Fund. Every telecommunications service provider shall establish a cash security fund, or provide the County with an irrevocable letter of credit in the same amount, to secure the cost of removing an antenna, antenna array, or tower that has been determined to be abandoned under Section 7.10.23(R), in the event the owner fails to comply with the provisions of Section 7.10.23(R). The amount of the cash security fund or letter of credit to be provided as follows: 1. For each commercial telecommunication tower, cell-on-wheels, and the initial set of antenna or antenna array ..... $25,000.00 2. For each co-located telecommunication provider's antenna or antenna array ..... 5,000.00” We are not sure if this type of using requires a bond or security fund. Please advise. Did we require it on the existing dish? I really don’t think they fall under the telecommunication tower ordinance but I can be wrong and I would imagine that Katherine would need to defer to our outside counsel on Towers.
