Good morning Mr. Giles,
Mr. Giles,
I have been evaluating the Code with my colleagues to confirm if your proposal to store/display your spa
and swimming pool products within a fenced in area would be permitted; however, the findings are that
the Code will not permit the proposal.
Your site, which is located at 7330 S US Highway 1, is zoned CG (Commercial, General). Pursuant to LDC
section 7.10.02. - Outdoor Displays in Commercial Zoning Districts, “In all commercial zoning districts,
and except as noted below, all business activities shall be in a completely enclosed structure.” The fence
does not meet the intent of the Code as it is not completely enclosed (excluding a roof).
If you would like to pursue installation of a completely enclosed building we would strongly encourage a
Pre-Application meeting with the Development Review Committee as significant site improvements will
be required. A new building would require Site Plan approval. Any nonresidential development is excess
of 6,000 s.f. requires site plan approval via the respective application process. As part of the review, the
entire site would need to comply with the Code. This includes compliance with the Community
Architectural Standards, which does not permit metal buildings. And supplemental site improvements,
such as stormwater, landscaping, and paved vehicular use areas/parking. All vehicular use areas must be
constructed of all weather surface material meeting the dimensional standards of the Code.
The spas can be stored interior to the existing building for display. Unfortunately, this means that the
fence permit may not be issued.

Im Phillip’s father, Larry, and I’m handling getting 7320/7330 S Federal Hwy ready to
open.
I’m having an architect draw up the area for display. We sell pavers, hot tubs, above
ground pools, gazebos and Swim Spas. All of these will fall under the category for
outdoor display.

Good afternoon Phil,
I have some questions regarding your new business.
1. Will you be occupying the entire building? Prior to you, it has been leased as
three individual bays and I just need clarification for addressing purposes.
2. Can you provide a plan that show where you are proposing outdoor displays?
The plan for the fence permit conflicts with the Code allowance for outdoor
displays in the CG Zoning District. I have attached the section for your review.
“The display of merchandise at the entry to any retail establishment shall be
permitted provided that the merchandise displayed is limited to the width of the
business stores frontage; the merchandise displayed is located on the sidewalk
immediately adjacent to the stores primary street/parking lot frontage; the display
of merchandise does not extend more than ten (10) feet from the wall of the
commercial building; that a minimum six-foot wide pedestrian path is to be
maintained along the sidewalk in front or, or adjacent to the business; and that the
displayed merchandise is not located or placed in any traffic or access aisle, parking
space, landscaped area, required fire lane or other emergency access path and
does not obstruct any fire hydrant or other fire service connections. “
