A RESOLUTION APPROVING A VARIANCE FOR
CERTAIN PROPERTY LOCATED IN ST. LUCIE COUNTY, FLORIDA
WHEREAS, the Board of Adjustment of St. Lucie County, Florida, based on the testimony and
evidence, including, but not limited to the staff report, has made the following determinations:
Petition of Richard ,lames for a Variance to permit a pool screen enclosure to be
constructed on an existing concrete slablwall, to encroach into the required minimum 15-
foot rear yard setback, providing a 0.5 foot rear yard setback and a 11.0' X 16.0' (176 sq.
ft.) existing shed to encroach 10.8 feet into the required minimum 15-foot rear yard
setback, providing a 4.2 foot rear yard setback within the RS-4 (Residential, Single -
Family — 4) Zoning District.
2. On October 28, 2020, this Board held a public hearing on the petition, after publishing a
notice of such hearing in the St. Lucie News Tribune, installing a sign on property and
notifying by mail all owners of property within 500 feet of the subject property.
3. After consideration of the testimony presented during the public hearing, including staff
comments, exhibits, and the standards of review for granting variances set out in Section
10.01.02, St. Lucie County Land Development Code, the Board of Adjustment has made
the following determinations:
The requested variance has met the standards of review as set forth in Section
10.01.02, St. Lucie County Land Development Code and is not in conflict with the goals,
objectives, and policies of the St. Lucie County Comprehensive Plan, because,
a. The Variance request is the minimum variance that will make possible the
reasonable use of land and structures, as the existing pool was constructed in
1979 without the need for a variance. The Variance will permit the property
owner continued enjoyment of the existing pool with the added comfort of
protection from insects.
b. The Variance request received support from adjacent property owners and is not
expected to harm other properties or improvements in the neighborhood, nor is it
expected to impair an adequate supply of light or air to adjacent public streets.
c. The granting of the Variance request will not permit the encroachment of the
screen enclosure to extend beyond the existing concrete slab/wall.
d. The granting of the Variance is not entirely in conflict with the general spirit and
intent of the St. Lucie County Land Development Code and the Comprehensive
Plan that implements policies to preserve, protect, and improve the public
health, safety and comfort within the County.

NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of St. Lucie County,
Florida:
A. Petition of Richard James for a Variance from the provisions of St. Lucie County Land
Development Code Section 7.04.01 (Table 7-10) Lot Size and Dimensional
Requirements, to permit a pool screen enclosure to encroach into the required minimum
15-foot rear yard setback, providing a 0.5 foot rear yard setback and a 11.0' X 16.0' (176
sq. ft.) existing shed to encroach 10.8 feet into the required minimum 15-foot rear yard
setback, providing a 4.2 foot rear yard setback, for the property depicted on Exhibit "A"
and described below, as shown on the boundary survey created by Know It Now, Inc.
and building plan submitted by Florida Engineering LLC, submitted to the Planning and
Development Services Department and date stamped on August 25, 2020.

THEREOF, AS RECORDED IN PLAT BOOK 11, PAGE(S) 41, OF THE
PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA.

B. Based on the evidence presented, this variance to encroach into the required minimum
15-foot front yard setback is approved.
C. This variance shall expire twelve months from the date of adoption unless a building
permit is approved or an extension is granted in accordance with Section 10.01.06, of
the St. Lucie County Land Development Code.
D. This Order shall become effective upon the date indicated below. An appeal from the
Board of Adjustment's action must be filed with the courts of the State of Florida within
thirty (30) days following the rendition of the decision of this order in accordance with
Section 10.01.07, of the St. Lucie County Land Development Code.
E. This Order shall be recorded in the public records of St. Lucie County.
