M[Intym County Attorney 23CO Virginia Avenue Fort Pierce, FL34902 REVOCABLE LICENSE AGREEMENT THIS AGREEMENT, made and entered this L-th day of '� 2020, by and between ST. LUCIE COUNTY, a political subdivision of the State of Florida, (the County) and Dalton & Debra Logsdon, whose address is 3014 South 81h Street Fort Pierce, Florida 34982 (Owners). WHEREAS, the Owners are requesting to put a driveway in Marie Road, In Jay Gardens Subdivision. See attached Exhibit "A". The County does not maintain the roads in Jay Gardens. WHEREAS, the County is willing to permit the Owners to use a portion of Marie Road near Lot 12 & 13 only, for a small and narrow driveway to their property, subject to the terms and conditions set forth in this Revocable License Agreement. NOW, THEREFORE, in consideration of the mutual covenants set forth herein, the parties agree as follows: 1. The County agrees to grant the Owners a Revocable License Agreement for the purpose of constructing a driveway on Marie Road from the north at Lot 12 & 13 with no clearing or grading that would disturb the drainage in the area. The driveway as shown in Exhibit "A" shall not extend any further in the right-of-way of Marie Road then the location of Lot 12 & 13. 2. The sole purpose of this Revocable License Agreement Is to allow the Owners to construct a driveway and maintain the area of the driveway in the right-of-way of Marie Road and shall not extend to the construction and/or installation of any additional structures or utilities. 3. Pursuant to the terms and conditions contained in this Agreement, the County authorizes the Owners to install the driveway and maintain the area of the driveway at the I OR BOOK 4467--�?AGE 941 _ location identified in Exhibit "A". The Owners must contact the Permitting Department, Environmental Resources Department, and Water Quality Division for any permits needed. 4. The Owners shall build and maintain the driveway In accordance with Standard Specification for Public Works Construction In St. Lucie County. The driveway shall not interfere with the drainage, County use of the right-of-way and any damage to the right-of-way shall be repaired by the Owners. 5. The County may ask the Owners to perform certain alterations to the driveway and location in the right-of-way mentioned in Exhibit W at the Owner's sole expense. However, If such alterations are not, performed to the satisfaction of the County Departments, the County shall be entitled to exercise Its rightto terminate this Agreement. 6. The term of this Revocable License Agreement shall begin on the date first above written and shall remain in effect unless otherwise revoked or abandoned as provided herein. 7. Owners agrees to relocate the referenced driveway, at any time and at no cost to the County, if necessary, for the maintenance or Improvements of the right-of-way and or County property. S. The Owners agree to allow County employees access to the location of the driveway for County purposes as determined by the County Engineer or Building and Code Regulation Manager. 10. All notices, request and other communications dealing directly or indirectly with this license shall be in writing and shall be (as elected by the person giving such notice) hand delivered by messenger or carrier service, telecommunicated, or mailed by registered or certified mail (postage prepaid) return receipt requested, address to: As to the County:. As consideration for the County granting this Revocable License Agreement the Owners agrees to indemnify and hold the County harmless from and against•all clalins,'liabilily, demands, damages, expenses, fees, fines, penalties, suits, proceedings, actions and costs of actions, including reasonable attorneys fees of any kind or nature arising or in any way connected with the use, occupation, management, or control of the above property by County or its' agents, servants, employees, patrons, or invitees, or resulting In injury to persons or property, or loss of life or property of any kind or nature whatsoever, sustained during Owner's use of the property. 12. The Owners shall promptly pay to record this Revocable License Agreement in the Official Records of St. Lude County, Florida.
