SMITH, CLERK OF THE CIRCUIT COURT - SAINT LUCIE COUNTY FILE # 4771792 OR BOOK 4497 PAGE 873, Recorded 10/26/2020 10:18:04 AM PDS ORDER 2020-066 FILE NO.: WDA-7202025803 AN ORDER GRANTING APPROVAL TO ALLOW LUMBER AND OTHER BUILDING MATERIALS DEALERS ASSOCIATED WITH SPECIAL TRADE CONTRACTORS AS A PERMITTED USE WITHIN THE U (UTILITIES) ZONING DISTRICT FORA CERTAIN PROPERTY LOCATED AT 6690 N US HIGHWAY 1, FORT PIERCE, SITUATED IN ST. LUCIE COUNTY, FLORIDA WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request to allow lumber and other building materials dealers associated with special trade contractors as a permitted use within the Utilities (U) Zoning District for a site located at 6690 N US Highway 1, Fort Pierce, Florida, and made the following determinations: On August 1, 1990, the Board of County Commissioners of St. Lucie County, Florida, adopted the St. Lucie County Land Development Code and has adopted amendments to the Land Development Code through certain ordinances. 2. On May 15, 2012, the Board of County Commissioners of St. Lucie County, Florida, adopted Ordinance 12-003 granting the Planning and Development Services Director the authority to make the determination after full analysis of all potential impacts that a proposed use complies with the provisions of the St. Lucie County Comprehensive Plan and Land Development Code. The analysis was provided by staff in the memorandum titled Hardscapes, Inc. Use Determination dated October 7, 2020, and attached to this Order. The determination to allow lumber and other building materials dealers associated with special trade contractors as a permitted use, within the Utilities (U) Zoning District located at 6690 N US Highway 1, is consistent with the general purpose, goals, and objectives of the St. Lucie County Comprehensive Plan, the Land Development Code, and is in the best interest of the health, safety and public welfare of the citizens of St. Lucie County, Florida 4. The determination to allow lumber and other building materials dealers associated with special trade contractors as a permitted use, within the U (Utilities) Zoning District until such time that the County rezones the subject property to the CG (commercial General) Zoning District. 5. The proposed determination will not have an undue adverse effect on adjacent properties, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare near this site within the Utilities (U) Zoning District. NOW, THEREFORE, BE IT ORDERED: BY THE PLANNING AND DEVELOPMENT SERVICES DIRECTOR OF ST. LUCIE COUNTY, FLORIDA: Hardscapes Inc. request has been determined to be consistent with similar permitted uses in the U (Utilities) Zoning District, and, as such, is determined to be a permitted use in the Utilities Zoning District at the site located at 6690 N US Highway 1, Fort Pierce, Florida, subject to the following conditions: 1. Wthin 30 days of this WDA approval, the applicant/property owner shall submit a Zoning File No.: WDA-7202025803 PDS Order 2020-066 Page 1 OR BOOK 4497 PAGE 874 Compliance application to the Planning Department in accordance with the LDC Section 11.05.00. 2. Within 90 days of this WDA approval, the applicant/property owner shall submit a rezone application to the Planning Department in accordance with the LDC Section 11.06.03. 3. Per the LDC Section 7.10.02, no outdoor displays maybe located in any required off-street parking area, a required off-street loading area, easements, any required landscape area, designated environmental protection area or any adjacent public right-of-way. 4. If any exterior changes are made to the existing building, or a new building is constructed. The Community Architectural Standards shall apply. PART A. SEVERABILITY If this Order or any provision thereof shall be held to be inapplicable to any person, property, or circumstances, such holding shall not affect its applicability to any other person, property, or circumstances. PART B. APPLICABILITY OF ORDER This Order shall only constitute approval to allow lumber and other building materials dealers associated with special trade contractors (SIC Code 5211, 1741, and 1752) as a permitted use within the U (Utilities) Zoning District for the site located at 6690 N US Highway 1, Fort Pierce, Florida, with the above listed conditions.
