LUCIE COUNTY, FLORIDA 7 8 WHEREAS, the Board of Adjustment of St. Lucie.County, Florida, based on the testimony and 9 evidence, including, but not limited to the staff report, has made the following determinations: 10 11 1. Petition of Ronald Marsilia_ for a variance from the minimum building .setback 12 requirements in the Harbour Ridge, Harbor Village Planned Unit Development.(PUD)for 13 a proposed swimming pool and screen enclosure on 0.72 acres to encroach 7 feet and 14 10 feet, respectively into the required minimum 30 foot rear yard setback. 15 16 2. On January 25, 2017 this Board held a public hearing on the petition, after publishing a 17 notice of such hearing, installing a sign on property and notifying by mail all owners of 18 property within 500 feet of the subject property. 19 20 3. After consideration of the testimony presented during the public hearing, including staff 21 comments, exhibits, and the standards of review for granting variances set out in Section 22 10,01.02, St. Lucie County Land Development Code, the.Board of Adjustment has made 23 the following determinations: 24 25 The requested variance meets the standards of review as set forth in Section 10.01.02, 26 St. Lucie County Land Development Code and is not in conflict with the goals, 27 objectives, and policies of the St. Lucie.County Comprehensive Plan, because 28 29 a) .There were no oral objections made from the public at the meeting in regards to 30 the variance, 31 32 b) The variance does not impair or otherwise injure other property values or 33 improvements in the area in which the subject property,is located; and 34 35 c) The variance request received approval from the Harbour Ridge Property 36 Owners Association. 37 38 NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of St. Lucie County, 39 Florida: 4.0 41 Petition of Ronald Marsilia for a variance from the minimum building setback 42 requirements in the Harbour Ridge, Harbor Village Planned Unit Development (PUD) for 43 a proposed swimming pool and screen enclosure on 0.72 acres to encroach 7 feet and I 44 10 feet, respectively into the required minimum 30 foot rear yard setback, for the 45 property depicted on the attached map as Exhibit"A" and described as follows: 46 47 LOT 26, HARBOUR RIDGE PLAT NO.1, ACCORDING TO THE PLAT THEREOF AS JOSEPH E.SMITH,CLERK OF THE CIRCUIT COURT January 25,2017 SAINT LUCIE COUNTY BOA Resolution No.17-001 File No.BA 1220165094 FILE# 4275254 02/0812017 12:33:66 PM Page 1 OR BOOK 3961 PAGE 1428-1430 Doc Type:ORD RECORDING: $27_00 I I : i S I RECORDED IN PLAT BOOK 23, PAGE 30, PUBLIC RECORDS OF ST.
