The subject 0.36-acre property is developed with a 1,500 square foot structure, constructed in 1975, which is nonconforming. The applicant seeks to obtain a Certificate of Zoning Compliance to operate Sandpiper Auto Repair at the above -referenced property. The business proposes a variety of uses, inclusive of an automobile repair shop, vehicle storage facility, and used automobile sales dealership. Pursuant to Section 3.01.03(T) of the St. Lucie County Land Development Code (LDC), automobile repair, vehicle storage, and used automobile sales are permitted uses within the IL (Industrial, Light) Zoning District, if the use(s) meet the required LDC standards including, but not limited to, paving, drainage, landscaping, building occupancy, etc. The project was reviewed through the St. Lucie County SDA Program, with enclosed comments provided by internal departments and divisions. The comments in this report are based on the above information and materials received and date stamped by the Planning and Development Services Department on February 12, 2020. B. Prior to issuance of a Certificate of Zoning Compliance, all proposed development, and use activities on the subject property shall comply with the provisions of the St. Lucie County Land Development Code and Florida Building Code. 1) Pursuant to LDC 10.00.03, the existing 1,500 square foot structure is nonconforming as it does not meet the required minimum yard setbacks outlined in LDC Section 7.04.01 - Table 7-10 for the IL Zoning District. A nonconforming structure may be continued in accordance with the provisions of this Code. However, no such expansion shall be allowed if it results in a greater dimensional nonconformity than that which previously existed. Normal maintenance and repair of nonconforming structures may be performed. 2) Pursuant to LDC Section 7.06.00 any change in use will require that all on -site parking and loading facilities be brought into full compliance with the provisions of this Code. For the purposes of this Section, "change in use" 'shall mean any change in use or activity that requires the issuance of a new Certificate of Zoning Compliance. ➢ All required off-street parking spaces, access aisles, vehicular use, and off-street loading areas shall be constructed with an all-weather surface meeting the requirements of the St. Lucie County Public Works Department. The permitted impervious surface materials shall be concrete, asphalt, brick pavers, stamped concrete, or paving block. ➢ No paving or vehicular use areas shall be installed within ten (10) feet of an adjoining property or within fifteen (15) feet of any road right-of-way frontage. Relocate the parked vehicles accordingly. No customer/employee parking or storage of vehicles within the right-of-way along Dale Place. ➢ The minimum parking access aisle dimension for 90-degree parking is 26-feet, for both one-way and two- way aisles. Page 2 of 6 Petition: Seibring, i ryde - Site Development Assistance File No. SDA-2202025683 3) Provide a floor plan that identifies the building square footage dedicated to each proposed use to appropriately determine the minimum parking requirements. The 5th edition of the Institute of Traffic Engineers (ITE) Parking Generation identifies the required parking ratio as follows: - Land Use Code 841— Automobile Sales (Used), at 3.08 spaces per 1,000 square feet of gross floor area (GFA). Land Use 110 — General Light Industrial, at 0.65 spaces per 1,000 square feet of gross floor area (GFA). ➢ The minimum size of a standard parking stall shall be ten (10) feet X eighteen (18) feet. The stall width shall be increased to twelve (12) feet for handicap stalls and comply with ADA requirements. ➢ One (1) handicapped parking stall is required for the first fifteen (15) standard parking stalls. 4) Pursuant to LDC Section 7.06.02, an off-street loading space shall be provided for all industrial developments. For buildings less than fourteen thousand nine hundred ninety-nine (14,999) square feet, the required delivery space may have a minimum dimension of twelve (12) feet x thirty (30) feet with a fourteen -foot vertical clearance. 5) The existing driveway does not comply with St. Lucie County's LDC requirements. All commercial driveways within St. Lucie County shall be paved in accordance with LDC Section 7.05.06. The existing driveway shall be relocated to comply with the following: ➢ Construction of all paved driveways on property fronting on an unpaved roadway shall terminate at the right-of-way line. f ➢ The edge of a driveway shall not be less than twenty-five (25) feet from a side property line. ➢ The nearest perpendicular edges of any two (2) driveways on adjacent properties shall be separated by a minimum of fifty (50) feet. ➢ The maximum width for a one-way driveway shall be twenty (20) feet and forty (40) feet for a two-way driveway. 6) In accordance with LDC Section1.09.04, all waste receptacles shall be fully screened from any residential use. Dale Place is a 40ft County owned & maintained right-of-way. Page 3 of 6 Petition: SeiL,7ns, Clyde - Site Development Assistance File No. SDA-2202025683 Background The Environmental Resources Department (ERD) is in receipt of the February 14, 2020, date -stamped submittal from Planning and Development Services. The applicant is requesting Site Development Assistance (SDA) for a Zoning Compliance for an auto repair (auto storage and auto sales are exploratory at this time). The site is located just east of Angle Road at 3406 Dale Place. Findings Following the review of the site development application and as discussed during the pre -application meeting Thursday, March 26, 2020, ERD has provided the following comments/conditions shall be met prior to issuance of a Zoning Compliance: 1) Provide the required landscape, including the existing native trees onsite to help meet the landscape requirements per Land Development Code (LDC) 7.09.00., on a separate sheet of the boundary survey. Existing native vegetation may be used towards these requirements if it is consistent with the intent of the LDC, and shall include the following but not be limited to: a) A fifteen (15) ft. landscape buffer along adjacent Dale Place consisting of one (1) native shade tree every thirty (30) linear ft. and a twenty-four (24) inch tall continuous native hedge per LDC 7.09.04.A; b) Screen all vehicular use areas from adjacent properties with a forty-eight (48) inch tall continuous native hedge and one (1) native shade tree every thirty (30) linear ft. within the required ten (10) ft. wide landscaped buffer per LDC 7.09.04.B; c) Where adjacent to residential use, provide a minimum ten (10) ft. landscape buffer consisting of an eight (8) ft. opaque wood fence/masonry wall, landscaped with a twenty-four (24) inch tall continuous native hedge on both sides, and one (1) native shade tree every thirty (30) linear ft. alternated so that at least sixty percent (60%) of trees are located on the outside of the fence/wall shall be provided. The fence/wall requirement may be waived if the adjacent residential owner(s) submit a signed and notarized consent form, however, the landscape material is still required per LDC 7.09.04.E; d) Provide interior vehicular use area landscape to the improved parking area per LDC 7.09.04.C; e) Waste receptacle shall be fully screened with a solid visual and auditory barrier, and/or a densely planted landscape screen consisting of evergreen shrubs/trees at least forty-eight (48) inch tall at planting per LDC 7.09.04.F; f) All landscaping is required to be irrigated by automatic means and mulched with a minimum of three (3) inches of non -cypress mulch per LDC 7.09.03, 7.09.04.L.3; 2) All Category I invasive plant species shall be eradicated from the site per LDC 7.09.05. Page 4 of 6 Petition: Seibring, i yde - Site Development Assistance File No. SDA-2202025683 All comments are based on the current Standards of Practice, established by the Board of Professional Surveyors and Mappers, Chapter 5J-17.050 thrii 5J-17.052 Florida Administrative Code, pursuant to current Section 472.027, Florida Statutes. SURVEY: 1) Please provide a boundary and topographic survey of the site with flood zones depicted. In addition, all wetland areas (if any) will need to be identified and shown on the survey. All elevations will be referenced to NAVD 1988. The survey,' needs to be performed by a professional surveyor licensed to practice in the State of Florida. Please provide a written response to, all comments. 1. Provide a survey identifying existing ground surface by type (asphalt, concrete, gravel, dirt, etc.). 2. Provide a plan showing the intended use of the site. All vehicular use areas will be required to be paved with asphalt or concrete. 3. The driveways do not appear to meet County standards. Dimension the driveway width, radius of return, and setback from side property lines and adjacent driveways. Section 7.05.06 of the Land Development Code includes minimum setback requirements for driveways. One of the driveways will, be required to be relocated complying with county dimensional standards or removed. The paving for the driveways shall terminate at the Right -of -Way line. 4. Stormwater runoff for any proposed additional impervious area will be required to be treated at a 2:1 ratio per LDC section 7.07.09. Identify on the plan where the stormwater will be treated. 5. Dimension the drive aisles and radius of returns on all curbed islands. 6. Provide typical pavement sections for all vehicular use areas. 7.. Provide a detail for the ADA accessible parking stall complying with current FDOT standards. 8. Provide details for curbing and sidewalk complying with current FDOT standards. 9. A Site Development Permit is required prior to performing site improvement activities. Subsequent to DRC approval, the applicant may submit the required documents to Grant Chambers, P.E. in the Engineering Division. Documents include a Right -of -Way Permit application, a Driveway Permit application, a Stormwater Permit application, two sets of plans, one copy of the stormwater report and other appropriate information.'
