Dear Mr. Powers:
The above referenced vacant parcel has a zoning designation of AR-1 (1 du/1 ac) and
is designated on the Land Use Classification Map as RS (Residential- Suburban
2du/1 ac).
The above parcel is nonconforming because it does not meet the required minimum
lot area of 43,560 square feet, the required minimum lot width of 150 feet, or the
frontage requirement of 30 feet. In order for a parcel to be considered a
nonconforming lot of record, and thereby qualify for a waiver of these requirements,
Section 10.00.04 of the Land Development Code provides that a parcel must exist in
separate ownership and not be contiguous to other lots in the same ownership prior
to July 1, 1984.
We have researched county records and found that this parcel was not contiguous to
other parcels in the same ownership prior to July 1, 1984. Accordingly, the parcel is
considered a nonconforming lot of record. As a result, the requirement for lot width,
lot area, and lot frontage are hereby waived. Accordingly, should the present home
be destroyed or demolished, a new single family residence may be constructed upon
the parcel subject to complying with all other applicable local, state and federal
codes.
