I am so sorry, I am just seeing this for the 1st time, and your last 2 emails sent to my company email went into
spam.
Thank you for forwarding this to our personal email.
I am not certain why the photo attached here was not received when I sent the documents over ? but here it is
again.
You will note the high tier and drop off that we are eliminating. My wife almost broke her leg misstepping over
the edge, and that isn't going to happen again. We have now removed that liability and want to make "sense" of
this small area as most of the other duplexes on the street have. We are very friendly with Pete and Paula that
own 46 attached, and they have no objection AT ALL to our deck redo.

RE: Building Permit #2011-0118
Dear Mr. Latham,
Please accept this letter in response to your building plans provided to the Building Division
on 12/11/2020, associated with Building Permit #2011-0118. The signed and sealed deck
plans indicate a finished deck height of less than 30 inches from the finished grade of your
lot. Based on these plans, an amended policy determination to allow for "At -Grade"
construction over 30 inches is not necessary. The current policy of the Planning and
Development Services Department allows "At -Grade" construction to be permitted within
the rear yard setback subject to limiting conditions. In a January 31, 1996 memorandum,
Phillip Freeland, Community Development Director at the time, provided the following
definition of "At -Grade" to provide clarity and avoid future conflicts:
At -Grade construction means the erection, placement or construction of any
concrete or like material, patio, wood or like material, deck, the top surface of which
is not more than 30 inches above the finished grade, and which is not supported by
any type of foundation or footer system capable of supporting or permitting the
erection or placement of walls or roofing systems. At -Grade construction meeting
these requirements may be located within any required side or rear yard, except in
the case of corner lots, provided that no public drainage or utility easement is
occupied or impinged without the expressed written release and authorization for
such occupation by all effected drainage or utility authorities. In the case of corner
lots, no At -Grade construction is to be permitted in any side or rear yard that abuts
a street or road right-of-way that would be in conflict with the minimum side or rear
yard setback standards of the applicable zoning district. This definition is `At -
Grade" construction does not apply to permitted driveway, sidewalk access to or
through a parcel or parking areas that are otherwise compliant with applicable
County regulations.
Your submitted building plans identified 12"xl2"x6" concrete footers. The plans examiner
is reviewing these plans to determine if the footer system identified will comply with the
subsection of the above policy prohibiting foundations and footer systems capable of
supporting the erection or placement of walls or roofing systems. The purpose of this
language is to prevent the construction of vertical structures within required setback, which
could have a deleterious impact on adjacent properties. Modification of your plans,
specifically the footer system may be necessary in order to comply with this determination.
