PROJECT DESCRIPTION: Construction of a 736 square foot dock serving a single family residence on Lot 22 of
the Riverbend Community. The dock's configuration and location are attached as
Exhibit 2.0. The project qualifies for a Letter of Consent pursuant to Section 18-
21.005(1)(c)1 and is subject to the attached General Conditions and Authorizations.
PROJECT LOCATION: ST LUCIE COUNTY, SEC 25 TWP 37S RGE 40E
PERMIT Five years from the date issued to complete construction of the surface water
DURATION: management system as authorized herein. Pursuant to Rule 40E-4.321, Florida
Administrative Code.
This is to notify you of the District's agency action concerning Notice of Intent for Permit Application No. 130816-16,dated August 16,2013.
This action is taken pursuant to Rule 40E-1.603 and Chapter 40E-40 and 40E-400,Florida Administrative Code(F.A.C.).
Based on the information provided, District rules have been adhered to and an Environmental Resource Permit is in effect for this project
subject to:
1. Not receiving a riled request for a Chapter 120,Florida Statutes,administrative hearing.
2, the attached 13 General Conditions (See Pages: 2-3 of 5),
3. the attached General Conditions for Authorizations for Use of Sovereign Submerged Lands (See Pages' 4-4 of 5).

The terms, conditions, requirements, limitations,and reslricticns set forth in this section arc general permit
conditions, and sha
ll-all be applicable to, and are binding u'pon the pear.ittes for all No NOtiCB and Nct',ced
General permits in this Chapter. These conditions are enforceable under Part IV of Citapter 373, F.S..
2. The general parn, it is valid only for the specific activity indicated, Any deviation from the specified activKy
and the conditions for undertaking that activity shall constitute a violation of the permit. 6,violation of the
pz�rrrjit is a suspension or revocation of the p5rmiftee's right to conduct such activity under tl?e general
permit. The District may begin legal proceatings seeking penalties or other remedies as provided by law
for any violation of thess conditions.
3. This general permit does not effrnftiate the necessity to obtain any required federal,State, local ant special
District aulhoflzat'mis prior to the start of any construdori, alteration,operation, maintenance, removal or
abandariman"r authcrl:zed by this pert-nit. This general permit does not convey to the peri-nitlee or create in
the permiftea any property riglit,or any interest in real property, nor does it authorize any entrance upori or
activities an property which is not owned or controlled by t'ie permittes, cr convey any riWits or privilegzis
other than thasa specified it the general pem K-and this Chapter.
This general Permit does no'. re!tsvea tine permittee from liab'lity and penalties when tie permitted actin ILY
causes han-n or injury to: human health or welfare; animal, plant or aquatic life; or property. K does not
allow the parmiflea to causs pollution in contravention of Florida statutes and District solos.
The permiRee is 1-isreby advised that Section 253.77, F.S., states that a person may not commanCS 2,-TV
excavation, construction,or other activity involving the use oi sovereign or other lei-ids of the State,th-a-this
to which is vested in, the Bogard of Trustees o'''the Internal improvement Trust Fund withou'!obtaining the
required lease, 'icerise, easarnent, or otherforim of consent authorizing the proposed use. Thorefora, he
prermitee is responsible for obtaining any ne-cossary authorizations from the Board of Trustees prior to
commencing activity on sovereignty lards or other state owned lands.
6. The general permit may be modt.lied, suspended or revoked in accordance with Chapter 12n-, and Section
373.429, F.S.
7. This permit shall not be 'transferred to a third party except pursuant to Section 4GE-4.351, F.A.C. The
permittee transferring the geneml permit shall romain liable for any coTrecfive actions that may be required
as a result 04 any Peni-Ift VIOL7@tion's prior to saia, conveyance, or oftar7ransfpr of ownership c.,cunt-c; or
the permitted syste,-,n or the real propeny at which the permitted system is located.
8. Upon reasonable notice-to the parmittee, Distrlct stafi with proper iderititr
icallon shall have pamilssion to
enter, inspect, sampl?and test the permitted system to insure confonnity with the plans and,specifications
approved by the permit.
The permittsa shall maintain any permitted systam ir accordance with the plans submitted to the District.
A permittee'stight to conduct a specific noticed acUvity under this naticad general permit is authorized for
a duration of 5 years.
Construction, alteration, operation, maintenance, removal F-,nz,' abaridonm3rit approved by 'Hlis genera;
permit shall be conductad in a manner which does not cause violations of State water quality standards,
including any antidegradatlon, provisions of Section 62-4.242(i)(a)and (b), 62-4.242(2)and (3), and C32-
302.300, F.A.C., and any special standards for outstanding Florida viaters and outstanding national
resource waters. The permittez shali implement best management practices for erosicn, turbidity, and

measures such as sodding, and seeding shall be implemented and shall be rnainiaBned on all eradible
ground areas prior to and during construction. Permanent erosion control measures such as sodding and
planting of we'lland species shall be completed within 7 days of any construction activity. Turbidity baniers
shall be installed and maintained at all locations where the possibility of transferring susponded solids Into
�vafiapds and Glhpr surface waters exists due to the permitted activity. Turbidity barriers shall rarnaln in
place and shall be mainlainad in a functional condition at all locations until construction is completed and
soils are stabilized and vegetation has been established. Thereafter the parmilrace shall be responsible for
tins removal of the barriers. The pem ittes, shall correct any erosion or shoaling that causes adverse
impacts to the water rpsourcss.
12. The permit-cc shall hold and save the District harmless from any and all damages, cla!rns, or liabi[KISS
which may arise by reason of the construction, alteration,operation, maintenance, removal,abandorirnent
or use of any systarn authorized by the general permit.
13. The, permUce shall immediately notify the District in writing of any previously submitted information that is
later discovered to be inaccurate.

Chapter 18-21.004(7), F.A.C., ,provides'that all authorizations granter] by rule or in vM ing under Rule 18-21.00-5,
F.A.C., except those for asluaculture activities and geophysical testing, shall be subject to the general conditions as
set£al th In paragraphs (a)through (i) below. The general conditions shall be gait of all authorizations under this
chapter, shall be binding upon the grantee, and shall be enforceable under Chapter 253 or Chapter 253, Part 11,
F.S.
Chapter 10-21.004(7), F.A.C., General Conditions for Authorizations:
(a) Authorizations are valid only for the specified activity or use. Any Unauthorized deviation from the speciffied
activity or use and the conditions for undertaking that activity or use shall constitute a violation. Violation oc the
auftTIZEMOn shall result in suspension or revocation of the grantee's use: of the sovereignty submerged land
unless cured-IQ the satisfaction offf the Board.
(b) Authorizations convey no title to sovereignty submerged land or water column, nor do they constitute
recognition or acknov1jlcdgrncnt of any other persort's fit e to such land or water.
(c)Authorizations may be modified,suspended or revoked in accordance with their terms or the romedies provided
in Sections 253.04 and 258.4.6, F.S.,or Chapter 13-14, F.A.C.
(d) Structures or activities shall be constructed and used to avoid or minimize adverse impacts to sovereignty
submerged lands and resources.
(e) Construction, use, or operation of the structure or activity shall not adversely affect any species which is
endangered, threatened or of special concern, as listed in Rules 6BA-27.003, 68A-27.004, and SBA-27.00 a,
F.A.C.
(ff) Structures or activities shall not unreasonably interfere with riparian rights. When acourt of competent
jurisd#cIVIop determines that riparian ri hts have been unlavfgully affected, the structure or activity shall be modifled
in accordance with the c urt's decision.
(g) Structures or activities shall not create a navigellocnai hazard.
(h) Structures shall b,e maintained in a functional condition and shall be repaired or removed U they become
dilapidated to such an extent that t,.ey are no longer functional. This shaft not be construed to prohibit the repair or
raplacernent -subject to the provisions of Rule 16-21.005, F.A.C., within one year, of a structure damaged in a
discrete event such i as a storm,flood, Accident,or fire.
(i) Structures or activities shall be constructed, operated, and maintained solely for viater dependent purposes, or
for nort-vialmr dependent activities authorized under paragraph 16-21.004(1)(g), F.A.C., or any other applicable
lave.

40E-400.427 General Permit for Certain Piers and Associated Structures.
Construction or extensions of the boathouse, boat shelter, beat fift, gazebo,or terminal p)aftrrns shall not
occur over submerged grassbads,coral communities, or wetlands. in addition,the boat mooring loca'U0,11
shall not bs otfar submerged grassbscls, coral communities, or wetlands. However, th- access walkway
portion of the pier may traverse these resources provided it is elevated a rninimum of 5 feet above mean
high water cr ordinary water, conl2ins handralis that are maintRinad in such 2 manner as to prevent use of
the access wa&ojays for boat mooring or access, and does not exceed a width of 6 feel, or a width of 4
fast in aquatic preserves.
2. There shall be no viel bars or living quarters over wetlands or other surface waters or on the pier, and no
structure authorised by this general permit sMl be enc[osed by walls or doors.
3. The structure and US us-shall not significantly impede navigabiRy in the water body.

5. There shall be no fish claanjn facilk[es, boat repair facilities or equipment, or fueflng faofllties on the
structures authorized by this general permR. In addition, no overboard discharges --f trash, human or
animal waste, or fuel shall occur from any structures authorized by this goan- qml permit,
This general permit shall not authoir[ze the construction of more than one pier per pascal of Pand or
individual lot. For the purposes of this general permit, multifamily living complexes shail be treated as one
parcel of pmpsrty regardless of the legal division of ownership of the associated property.
