Dear Mr.Voigt,
On January 27,2015,the Board of Directors of Nettles Island adopted a Resolution to
appoint decision making.powers to the Architectural Committee. Please°see the attached.
From time to time the Committee members or the Manager of the Association have
contacted St.Lucie County personnel for various information concerning construction on
Nettles Island,or other matters concerning the Association.
The Architectural Committee Members are currently: Howard Rickert,Janice
McLaughlin,Mike Magliano and Frank Fisher. Frank Fisher served on this committee
for numerous years during the past 9 years and consecutively since 2016. Mice Magliano
recently joined the committee. Howard Kicked and Janice McLaughlin have served
continuously since 2015. Board members are not required to have specific training to be
board members,so long as they sign an affidavit attesting to the fact that they have read
and agree to uphold the condominium's governing documents. The requirements for
Board members can be found in the State Statute 718.
Management,consisting of myself and Bill Harkins,sit in and present and assist
committee members with all architectural requests. There have not been any issues or
problems with the members reading or understanding construction and survey drawings
for the matters that the committee must address relative to the condominium's governing
documents. In the event there is a concern,the committee may request a professional
consultation.
The Association is not obligated to permit or allow a request that contradicts with,or
goes against-the condominium's governing documents. "Special.Situation Lot",as
defnaed.by St.Lucie.County:contradict with the Associations.goveming�,documents,
specifically..the Amended.and.R.estated.Declaration of Nettles Island,Article 16.1.3. .The ,
I Condomibium`s Declaration,eoncesningthe 10'front.setbackis.morerestrictive.,than the
Land Development Code-required by St.Lucie County-concerning Lot 545:
IFor your information,the Architectural Committee has been discussing a proposed
amendment to the condominium declaration to allow the association to adhere to the
specific St.Lucie County ordinances for the setbacks for new construction on those lots
which are deemed by St,Lucie County as"Special Situation Lots". The committee is
considering seeking Board approval to place the proposed amendment on the ballot at the
next annual meeting.

We have discussed the demolition of a garage under construction about a 1.5 week ago.The proposed garage permit
was issued and under construction. No inspections had been done yet. Customer is in a lawsuit with Nettles Island and
was ordered by the judge to remove the structure. Customer,has removed the structure without demolition permit. You
had advised no demolition permit was necessary as long as we have proof that the structure was gone. See attached

I disagree, the wood was rotting when the Judge Metzgar ordered my garage to come down( a legally
permitted Garage building permitted by Saint Lucie County under Florida State 718 Condominium
law( that was a violation of your permitting process, I removed some of the structure as the boards
have to be replaced anyway).The Judge apparently didn't read Florida state law that gives the
authority to rule_on special situation lots(which you have been ruling on for over 25 years to St. Lucie
County)The County should be ashamed of itself for not protecting us, property owners.
This law suit is still being pursued and we are confident we will win, it's bad enough the County is
given the rights to issue permits will not back up the process.
WE have a valid permit, you have insulted us with letting our condominium concept condo who have
NO CLAIM on my property tell the County what to do(tail wagging the dog syndrome).

Unfortunately the garage was down prior to your notification to me, the threat of incarceration was
simply too much, even now the same Judge has issued an appeal giving the Condo 60 days why I
should not be granted a certiaria writ( a new trial) as we have won this CASE, SOMEONE ONLY
NEEDS TO READ THE DECISION AND TRIAL ,COURT TRANSCRIPTS. WE ARE CONFIDENT
THAT WE WILL BE ALLOWED TO BUILD AS I HAVE IN PLACE A COUNTY ISSUED PERMIT. THE
SAME JUDGE ELIZABETH METZGER HAS ISSUED THIS NEW DECISION.
Secondly my wife still has knee problems for her second knee same knee replacement, which
infected her kidneys, I am tired and can't see with my recent cataract operation, waiting to have the
other eye done as well, she also has been hospitalized the last two weeks with kidney problems and
she has a bad heart, and a-fib so I can't respond to anything from you at this time . Please show me
some courtesy, she can't drive and neither can I right now, I have difficulty writing and seeing this

Good afternoon Mr. Voigt,
It was brought to the County's attention that the garage structure on your property has been removed under the Order by
Honorable Elizabeth Metzger, Circuit Court Judge. As mentioned in my email of 7/17/19, 1 advised you that a demolition
permit would be required to remove the garage; and, then you would need to close out the permit for the
garage. According to county records, there is no demolition permit for the removal of the garage structure; and, the
garage permit is still active. Any work done without a permit is a violation of the code and is typically followed with a
notice of violation from code enforcement. Code Enforcement would ask for an after the fact permit be obtained within 5
working days. I have not notified code enforcement yet on this matter. Please apply for an after the fact demolition
permit at your earliest convenience.

1&2 Family Home Demolition Permit Requirements .
The following items are required by this department in order to process your demolition permit.
1. Two copies of site plan showing the location of the existing home. (Photo Ok)
2. Completed and signed permit application.
3. Owner authorization allowing the contractor to obtain the permit or copy of recorded
"Notice of Commencement" if the value of the work exceeds $2,500.
4. Sunshine 811 Locate Ticket# (Utility Locater)
(Only if any type of excavation work is involved.) Call 811 or 800-432-4770
5. Signed affidavit of receipt. "Asbestos Notification Statement".
6. Provide one copy of the approved abatement plan (If available).
7. Toilet facilities for workers is required. (See code below)
8. Health Department septic system abandonment approval. (If required) Call 772-873-4931
9. Payment of all required fees.
Required Inspections:
1. Prior to the start of any demolition work including disconnection of utilities. (#161)
2. At the completion of all demolition, filling and Lot seeding/sodding. (If required) (#999)
Note: A minimum of 24-hour notice is required prior to any inspection.
All slabs and concrete must be removed.
Florida Building Code-Plumbing: TOILET FACILITIES FOR WORKERS
311.1General.
Toilet facilities shall be provided for construction workers and such facilities shall be maintained
in a sanitary condition. Construction worker toilet facilities of the nonsewer type shall conform
to ANSI Z4.3.
OSHA Commentary:
In general, toilets would be considered 'nearby' if it would take less than 10 minutes to get to them.

Open .PST File in Outlook
➢ Click File Tab at the top of Outlook > Click Open & Export >
Click Open Outlook Data File.
➢ In the window pane to the left of the box that opened click
on your H : drive.
➢ Now in the pane to the right go to the folder "Laura Jones"
and click to open.
➢ Inside you will see a file, Click the file and you will see it in
the bottom of the window pane.
➢ Click OK.
➢ This will now open the file in your Outlook.
➢ In the left pane of your Outlook look near the bottom and
you will see your file name of the file you just opened.
➢ Click on it and it will Y
open our file to view.

➢ Just click one at a time and you will see all the emails found
for your prerequisites > read emails as normal.
➢ When you are done you can click on the arrow next to the
file name to close the file.
➢ Once closed, you can right click and select close ""Laura
Jones" and it.will remove it from your Outlook.

To follow up on our conversation of last week. Please be advised if you decide to demolish the part constructed garage, a
demolition permit will be required and a letter to close out the building permit for the garage.
Your records request included correspondence between unit owners and the HOA Board. We don't have the
correspondence between unit owners and the HOA of Nettles. We do have email correspondence between the St. Lucie
County and Mrs. Jones, Manager of Nettles Island. We have a database of about 2,000 emails. We will need to go thru
each individual email to make sure it is of significance for you. This research will take time. Please let me know if you
would like these emails.
