This is to advise you that you have not complied with the Order of the Code Enforcement Board dated April S, 2017. Since you did not comply with the Order, a fine of $250.00 per day with a maximum fine not to exceed $5,000.00 has been imposed beginning September S, 2017. No additional prosecution cost has been imposed. If the case is not brought into compliance and the fine is not paid the attached Order Imposing Fine/Lien shall be filed in the Office of the Clerk of the Circuit Court in and for St. Lucie County,Florida. The Order Imposing Fine/Lien will constitute a lien in the amount of the fine against the property described therein and any other real or personal property owned by you. Pursuant to Section 1-2-25(c)of the St. Lucie County Code,after three months from the filing of this lien,if the lien remains unpaid,the Code Enforcement Board may authorize that this lien be foreclosed against your property. If you correct the violations,you must immediately contact the Code Enforcement Department at(772) 462-1571,Monday through Friday, 8:00 a.m. to 5:00 p.m. to arrange for an inspection of your property and to stop the fine from continuing to run. LUCIE COUNTY CODE ENFORCEMENT BOARD ORDER IMPOSING FINE/LIEN CASE NO. 90254 ELI AND AYALA NISIM THIS CAUSE came on for a Fine Hearing before the St. Lucie County Code Enforcement Board ('Board") on the 7' day of June, 2017, after due notice to the Violators, Eli and Ayala Nisim. As Violators,Eli and Ayala Nisim did not appear for the hearing, the Board having heard testimony under oath, received evidence, and heard argument of counsel, thereupon issued its Order Imposing Fine/Lien as follows: 1. On April 5, 2017 this Board issued its Findings of Fact, Conclusion of Law, and Order determining that a violation of Section 11.05.01, Building and Sign Permits, of the St. Lucie County Land Development Code existed on the property located at 230 SE Camino St., Port St. Lucie,FL on property described as: RIVER PARK-UNIT 3- BLK 28 LOT 39 (MAP 34/22S) (OR 3638-1185) as recorded in the Public Records of St. Lucie County. The Violators were given until May 5, 2017 to abate the violation. 2. Based upon testimony of the Code Enforcement Staff, this Board determines that a violation of Section 11.05.01, Building and Sign Permits, of the St. Lucie County Land Development Code, continues to exist as the Violators have not obtained a building permit for the converting the garage into living space, on the property described above. 1 3. Pursuant to the authority granted by Section 162.09, Florida Statutes, and Section 1-2-25 of the St. Lucie County Code of Ordinances, and after considering the gravity of the violation, any actions taken by the Violators to correct the violation, and any previous violations committed by the Violators, this Board orders the Violators to pay a fine of two hundred and fifty 00/100 dollars $250.00 per day for each day the violation continues beginning September 5, 2017, with the maximum fine not to exceed five thousand and 00/100 dollars ($5,000.00). No additional prosecution cost has been imposed. 4. Pursuant to Section 162.09, Florida Statutes, and Section 1-2-25, St. Lucie County Code of Ordinances, this Order may be recorded in the Public Records of St. Lucie County, Florida, and shall constitute a lien against any real or personal property owned by the Violators. This Order will continue as a lien until the violation has been abated and the fine ordered in paragraph 3 above is paid. Any Party requesting a rehearing or reconsideration of the Board's action must file a written request setting forth the legal grounds therefore with the Code Enforcement Board Secretary, St. Lucie County, 2300 Virginia Avenue, Fort Pierce, FL 34982 within thirty (30) days of the date of this order. Any aggrieved party, including the local governing body, may appeal a final administrative order of an enforcement board to the circuit court. Such an appeal shall not be a hearing de novo but shall be limited to appellate review of the record created before the enforcement board..
