A RESOLUTION GRANTING A VARIANCE FOR
CERTAIN PROPERTY IN ST. LUCIE COUNTY, FLORIDA
WHEREAS, the Board of Adjustment of St. Lucie County, Florida, has made the following
determinations:
1. ,Terry James, presented a petition for a Variance from the Provisions of Section
7.04.01(A), per Section 10.01.03(A)(1)(b), of the St. Lucie County Land
Development Code to permit the development of property into lots which would lack
100 percent of the minimum 60 feet of road frontage required in the AG-5
(Agricultural - 1 du/5 acres) Zoning District.
2. On March 15, 2000, this' Board held a public hearing on the petition, after publishing
a notice of such hearing and notifying by mail all owners of property within 500 feet
of the subject property. '
3. After consideration of the testimony presented during the March 15, 2000, public
hearing, including staff comments and the standards of review for granting variances
set out in Section 10.01.02, St. Lucie County Land Development Code, the Board of
Adjustment has made the following determination:
The requested variance has met the standards of review as set forth in Section
10.01: 02, St. Lucie County Land Development Code and is not in conflict with the
goals, objectives, and policies of the St. Lucie County Comprehensive Plan, because:
a. The variance granted is the minimum variance that will make possible
the reasonable use of the land, structure, or building.
b. The variance ranted will not impair other roe or improvements

C. The variances granted meet the general spirit and intent of the St. Lucie
County Land Development Code and the St. Lucie County
Comprehensive; Plan.
NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of St. Lucie
County, Florida:

A. The petition of Jerry James for a Variance from the Provisions of Section 7.04.01(A),
per Section 10.01.03(A)(1)(b), of the St. Lucie County Land Development Code to
permit the development of property into lots which would lack 100 percent of the
minimum 60 feet of road frontage required in the AG-5 (Agricultural - 1 du/5 acres)
Zoning District, is granted for the following described property:
SUBDIVISION OF MCNURLEN FARMS BLOCK 3 WEST 1/2 LOT 1, ALL LOTS 2 & 3,
WEST 1/2 LOTS 4 & 5, ALL LOTS 6 & 7 & WEST 112 OF LOTS 8,10,11,14 & 15 & BLOCK
6 LOT 2. (Tax ID#: Part of 2320-701-0001-000/8)
(Location: West side'of Brocksmith Road, approximately 1.5 miles north of Okeechobee
Road)
B. This variance shall expire twelve months from the date of adoption unless a final plat
is approved or an extension is granted in accordance with Section 10.01.06, of the St.
Lucie County Land Development Code.

STANDARDS OF REVIEW AS SET FORTH IN SECTION 10.01.02,
ST. LUCIE COUNTY LAND DEVELOPMENT CODE
In reviewing this application for a Variance to the'St. Lucie County Land Development
Code, the Board of Adjustment shall consider and make the following determinations:
1. The variance requested arises from conditions that are unique and peculiar to the
land, structures, and buildings involved; that the particular physical surroundings,
the shape, or topographical condition of the specific property involved would result
in unnecessary hardship for the owner, lessee, or occupant, as distinguished from a
mere inconvenience, if the Provisions of Section 7.04.01(A), per Section
10.01.03(A)(1)(b), are literally enforced; that they are conditions that are not
ordinarily found in the same Zoning District, and the conditions are created. by the
regulations of Section 7.04.01 (A), per.Section 10.01.03(A)(1)(b),of this Code, and not
by an action or action's of the property owner or the applicant.
The subject property is located on the west side of Brocksmith Road, approximately 1.5
miles north of Okeechobee Road. The applicant would like to subdivide approximately 50
acres into lots which would be a minimum of 10 acres in size and lack 100 percent of the
minimum 60 feet required for lots in the AG-5 (Agricultural - 1 du/5 acres) Zoning
District. Access to the property will be provided through a 32 foot dedicated easement
from Brocksmith Road.
The variance sought arises from conditions that are unique and peculiar to the land
involved and the denial,of a variance may result in an unnecessary hardship as defined in
the St. Lucie County Land Development Code. The need for the variance requested was
caused by previous actions of property owners of the subject property and adjacent
properties when the lots were created and split several times.. The requested variance is
consistent with the general spirit and intent of the St. Lucie County Land Development
Code and the St. Lucie County Comprehensive Plan. Section 10.01.03(A)(1)(b) of the
Land Development Code allows the creation of lots in the AG-5 Zoning District without
the required 60 feet of road frontage, if they have a dedicated ingress/egress easement.
2. The granting of the variance will not impair or injure other property or improvements
in the neighborhood in which the subject property is located, nor impair an adequate
supply of light or air to adjacent public streets, increase the danger of fire, endanger
the public safety, or i substantially diminish or impair property values within the
neighborhood.
The granting of the requested variance is not expected to impair or injure other property
or improvements in the neighborhood.
3. The variance requested is the minimum variance that will make possible the
reasonable use of the land, building, or structures.

The requested variance is the minimum needed to allow the subdivision of the lots into
home sites.
4. The variance desired will not be opposed to the general spirit and intent of this Code
or the St. Lucie County Comprehensive Plan.
The requested variance is consistent with the general spirit and intent of the St. Lucie
County Land Development Code and the St. Lucie County Comprehensive Plan.
The subject property is located on the west side of Brocksmith Road, approximately 1.5
miles north of Okeechobee Road. The applicant would like to subdivide approximately 50 acres
into lots which would be a minimum of 10 acres in size and lack 100 percent of the minimum 60
feet required for lots in the A6-5 (Agricultural - 1 du/5 acres) Zoning District. Access to the
property will be provided through a 32 foot dedicated easement from Brocksmith Road.
The variance sought arises from conditions that are unique and peculiar to the land
involved and the denial of a variance may result in an unnecessary hardship as defined in the St.
Lucie County Land Development Code. The need for the variance requested was caused by

were created and split several times.. The requested variance is consistent with the general spirit
and intent of the St. Lucie County Land Development Code and the St. Lucie County

Staff has reviewed this petition and determined that it conforms with the standards of
review as set forth in Section 10.01.02, St. Lucie County Land Development Code and is not in
conflict with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan.
Staff, therefore, recommends ,approval of the requested variance.
