(referred to herein as "Association") whose post office address is 5951 Travelers Way, Fort Pierce, FL 34982. Association is the homeowners association operating the Palm Grove community according to the Declaration of Restrictions recorded at Official Records Book 070C, Page 2973, Public Records of St. Lucie County, Florida. 2. This Agreement concerns the following Lot (hereinafter "Lot'): Lot, PALM GROVE according to the Plat thereof recorded in Plat Book 31, Pages 4, 4a, 4b, 4c and 4d, Public Records of St. Lucie County, Florida Address of the Lot 3. Owner(s) have requested approval to alterthe Lot by installing a fixed (non -portable) generator, small concrete pad and fuel tank. Owner(s) represents that one of owner(s) needs to alter the Lot because that Owner suffers fr o m a disability necessitating constant electrical power and /or a constant supply of oxygen during a power outage. The fixed generator would otherwise violate the Association Architectural standards, setback limitations, and would not otherwise be permitted by Association. Generator to be installed by a licensed professional. 4. Owners shall, as a condition of installing the generator, obtain a permit from the county, and provide Association with a copy of that issued permit. Said installation shall comply with all county set back requirements. 5. Further, Owners) shall obtain approval from Association as to the location to prevent damage to any water, electrical, irrigation system wires or lines, or other utility lines from being damaged. 6- Owner(s) shall have the generator regularly serviced by a professional as recommended by the manufacturer. Association may require Owner(s) to provide proof of such servicing. 7. Owner(s) indemnify Association from any all claims for damage to persons and properly in connection with the generator. Owner(s) and any successor owner of the lot indemnify Association for any soil contamination from fuel. This damage shall include all attorneys' fees and costs incurred by Association. 8. The Agreement may be recorded in the Public Records of St. Lucie County, Florida and will bind the lot as a covenant running with the land of the lot.
