Project Description: Applicant requests a Vegetation Removal Permit for the removal of vegetation in
association with Building Permit #2006-0579. The development project was approved through the building permit
process to construct a commercial building for Unico Air Conditioning Company with parking, stormwater, and
landscape improvements. The development project will impact 100" in diameter at breast height (DBH) of native
canopy trees meeting the mitigation thresholds outlined in 6.00.05.D, at the 2:1 ratio, resulting with 200" of
required mitigation. Per Land Development Code 6.00.05, this request qualifies for issuance of a Vegetation
Removal Permit. No impacts to any additional native veqetation are permitted at this time.
Background: The applicant was issued an AFTER -THE -FACT (ATF) Vegetation Removal Permit #20202112
on February 3, 2020 associated with the Notice of Violation (case #100181) for the removal of native vegetation
without a vegetation removal permit. During a site visit on 1/16/2020 staff observed evidence of three (3) native
oak trees had been removed requiring mitigation at the 4:1 ratio for a total of 188" DBH. To meet the required
ATF tree mitigation, the applicant preserved the remaining native canopy trees onsite.
The combined required mitigation (i.e., the deficient ATF mitigation of 26" DBH plus the 200" DBH of required
tree mitigation for the remaining trees to be impacted with the proposed development project) totals 226" DBH
of required mitigation. Mitigation for the combined required tree mitigation will be met by onsite preservation.

Permit #20200680 provides authorization for the removal of 100" DBH of native canopy trees at the 2:1
ratio, totaling 200". No additional impacts to native vegetation are permitted at this time.
General Conditions of Issuance:
• The following minimum standards for vegetation protection shall be applied to areas of vegetation designated
to be preserved. A barrier shall be placed and maintained around the tree's perimeter to form a continuous
boundary as specified below subject to restrictions as detailed below:
■ At a minimum distance of either ten (10) feet from the edge of groups of protected vegetation or from the
radius of the dripline from all protected trees, whichever is greater;
■ Protective barriers or protective designations shall remain in place until removal is authorized by SLC
ERD, or until issuance of a certificate of occupancy;
■ In the event that any protective barriers are removed or altered and clearing activities are conducted within
an area identified for preserve, SLC ERD is authorized to direct that all land clearing and site alteration
work at the site be stopped until the barriers are restored and any necessary corrective actions taken to
repair or replant any vegetation removed or damaged as a result of these encroachments.
• The preserve areas and tree preservation areas shall be maintained in their natural state, so as not to alter
the water and oxygen content of the soil and impair its function;
• A National Pollutant Discharge Elimination (NPDES) Permit from the Department of Environmental
Protection may be required for construction activities disturbing 1 acre or more. Please visit NPDES
Stormwater Program website at https://floridadep.gov/Water/Stormwater or contact Jose Vega, St. Lucie
County Stormwater Program Coordinator, at 772-462-1668 for more information.
• No grade changes or excavation of any sort may be made within the barricaded areas;
• If any excavation or other activities are expected outside of the preserve area or dripline, the roots should
first be pruned (to the depth of required excavation) to sever them cleanly;
• If underground utilities must be routed through a protected root zone area, tunneling under the roots shall be
required;
• If irrigation must be installed, it shall be outside of the dripline of all preserve areas and protected trees;
• No fill material, construction material, concrete, paint, chemicals, or other foreign materials shall be stored,
deposited or disposed of within a vegetation preservation area;
• No signs, permits, wires, or other attachments shall be affixed or attached to protected vegetation;
• No equipment, including passenger vehicles, shall be driven, parked, or stored or repaired within designated
vegetation preservation areas.
Post Clearing Requirements:
1. Mitigation: The combined required mitigation (i.e., the deficient ATF mitigation of 26" DBH plus the 200"
DBH of required tree mitigation for the remaining trees to be impacted with the proposed development
project) totals 226" DBH of required mitigation. Mitigation for the combined required tree mitigation will be
met by onsite preservation.
2. Landscaping: Landscape shall be in compliance with the approved landscape plan prepared by Sabine
Marcks, Landscape Design Associates, dated February 10, 2021.
