The Customer hereby agrees to pay ADT, its Agents or Assigns, the sum of $8,256.00 plus any applicable taxes, of which $0.00 shall be payable upon signing of this Rider and the balance payable upon completion of installation. In addition, Customer agrees to pay Monthly in advance the additional sum of $92.33. Customer agrees to pay the total Licenses and Permit Charge of $0.00 at the time of sale. The parties agree that the Agreement of which this Rider is made a part is and shall remain in full force and effect in accordance with all the terms and conditions thereof, modified only as specifically provided in this Rider. To the extent that there Is any conflict or inconsistency between the master terms and conditions and this rider, the terms and conditions of this rider shall control. The scope of work performed during a Quarterly inspection is in accordance with NFPA 2 In connection with any automatic sprinkler system on Subscriber's premises defined more particularly above, ADT Commercial shall provide (1) technician/fitter to Assistance from one of Subscribers staff may be required to perform non technical duties such as silencing and acknowledging alarms as they are received at the fire alarm panel: Project/Service Clarifications: 1. ADT Commercial requires owner to provide (keys or key holder) for unencumbered access for full building access during our inspection. Appropriate notice will be given. 2. Inability to access suites will be noted as inaccessible. 3. Charges will apply if return trips are necessary to inspect inaccessible areas. 4. All work is to be performed during normal working hours based on a forty (40) hour work week. 5. Prices quoted are effective for sixty (60) days from the date of this quotation unless extended in writing. 6. On site escort to be provided by customer at time of scheduled arrival. 7. Overtime work and overtime rates do not apply to this proposal. 8. Charges will apply if return trips are required for canceled appointments. 9. Unless otherwise specified, testing is limited to accessible devices, those where access can be obtained without restriction at the scheduled time of the test and does not exceed heights obtainable from the floor level. 10. Inspections of Units are required by the NFPA and the AHJ and are included/excluded from this agreement. 11. Inspect coverage of system and condition of sprinkler heads, branch lines, risers, cross mains, hangers and other related segments of the systems involved in accordance with NFPA 25 procedures 12. This inspection includes the inspection of painted heads. These are conducted form the from the floor level annually in exposed and readily accessible areas without the aid of ladders or lifts. The determination of painted heads or other elements of the system is very difficult from the ground and in certain lighting. RHFS will take reasonable steps to locate and provide a list of heads suspected of being painted. NFPA 25 stipulates that sprinklers may be painted only by the manufacturer and any painted sprinklers must be replaced. Any sprinkler that shows signs of any of the following shall be replaced: (1) Leakage (2) Corrosion (3) Physical damage (4) Loss of fluid in the glass bulb heat responsive element (5) Loading 13. CUSTOMER bears total responsibility for status and condition of all fire protection systems inspected by CONTRACTOR. 14. This service consists of imperfect visual inspections and pass -fail testing of specified items. It is not an engineering evaluation or a water supply analysis. CONTRACTOR shall report anything observed that is readily revealed through performance of work as outlined in NFPA-25, 2002 edition and included by specific reference in this agreement. Excludes: 1. Inspection & Testing, frequency requirements, as defined in NFPA 25 or specifically included in this proposal, less than Semi -Annually and greater than annually. Any daily weekly monthly three year or five year inspections as required by NFPA 25. 2. Performances of these activities are not included in this agreement unless described in specific addenda. Battery bulb replacements will be rescheduled and billed in -addition to this contract replacement is not part of the testing. When needed, batteries will be changed, disposed of and billed separately.. 3. Inspections of Units not specifically included above 4. Full flow test of Pressure Regulating valves. 5. Dry systems, Preaction systems any equipment not specifically included above s. Full flow test of Preaction and or Deluge systems not specifically included above. 7. Valve pit or equipment on city right of way 8. Fire Alarm System, Suppression Systems, Fire Extinguishers 9. Private not specifically included above 10. Public Hydrants 11. Confined Space requirement as; defined by OSHA attics crawl spaces etc. 12. Any additional sprinkler systems relative to this Agreement added to the above premises after the date of contract acceptance shall be inspected by Company. Subscriber shall pay an additional price commensurate with the usual charges made by Company for inspecting such additional systems at a price agreed upon by both Company and Subscriber. 13. Fire Watch is to be provided by the owner should the system be impaired. 14. Testing & treatment of the water supply, and any costs associated therewith, are not covered by this inspection and/or testing agreement and are the sole responsibility of the Subscriber. ALARM PMA AGREEMENTS DESCRIPTION OF SERVICE PLAN: The customer will receive one scheduled complete annual inspection of the entire covered system. In addition, ADTC will perform on -going maintenance as defined by the current service policies applicable to the respective building system(s). See Attachment for covered parts and tasks performed. ADTC will perform unscheduled repairs on the system upon request by the customer during ADTC's normal working hours, which includes adjustment and replacement of unserviceable parts in the system. The condition of parts on the system will be solely determined by ADTC and replaced on an exchange basis and parts will become the property of ADTC. Central Station Service for Fire Alarm Systems — ADTC will provide runner service in accordance with the system certificate. Customer is required to provide ADTC with 24/7 access to each fire panel. Runner Service on all Service Plans are to be billed at $185.00 per trip for the on call 4 hour response. INITIAL INSPECTION: An initial inspection of the system (during normal business hours included in the contract price) will be performed upon receipt of this signed agreement. If repairs are necessary, those repairs must be completed before system coverage will commence or excluded from coverage under this agreement at customer's request. Customer understands that if the contract is not accepted by ADTC due to the condition of the existing system or refusal to make initial repairs, the customer is responsible for the cost of the inspection at the current ADTC time & materials labor rates. (a) DOCUMENTA11ON CHECK LIST: Customer is required to provide the following documentation. ADTC will provide the Customer with a price to supply any missing documentation. • Fire Alarm System Record of Completion • As -Built (Record) Drawings • Point -to -Point Wiring Diagrams • Copy of Original Equipment Submittals • Individual Device Interconnection Drawings • Operation Manuals Manufacturer's Proper Testing and Maintenance Requirements CCEPTANCE BY ADTC OF FULL SERVICE MAINTENANCE: Full Service Maintenance is only available r a system meeting local code approval,and subject to final acceptance by ADTC service management. DTC reserves the right to inspect and/or evaluate all System, and in its sole discretion terminate the greement at any time. iNENTY FOUR HOUR SERVICE: Emergency service for after hours and weekends shall be dispatched i priority basis ERVICES NOT INCLUDED: Services not included in Full Service Maintenance will be charged in .cordance with ADTC time and material rates for Contract Customers then in effect. Full Service aintenance does not include the following; 1. Repair of damage from any cause other than ordinary use including fire, flood, acts of god, vandalism, and malicious mischief water intrusion, corrosion due to the environment. 2. Wiring and wiring faults unless installed by ADTC 3. Parts no longer manufactured obsolete 4. Equipment that is inaccessible 5. Ground faults s. Excludes all third party programming or delays as result thereof IncluslonsI&Ausions CUSTOMER will be responsible for providing updated drawings of the facilities. If the new drawings reflect changes not identified in the original proposal additional charges will be incurred by the CUSTOMER. CUSTOMER will be responsible for City, County and State alarm permit fees. ADT will perform the installation, conduct tests and inspections during normal business hours and days: 8AM to 5 PM Mon- Fri. using standard labor rates excluding Union and prevailing wage rates. Compliance If 1 have provided or do provide ADT Commercial, a division of ADT LLC. ("ADT") with a phone number, including but not limited to a cell phone number, a number that I later convert to a cell phone number, or any number that I subsequently provide for billing and other non -solicitation purposes. I agree that ADT or ADT LLC ("ADT') may contact me at this/these number(s). I also agree to receive calls and messages such as pre-recorded messages, calls and text messages from automated dialing systems at the nurnber(s) provided. I confirm that I am the registered owner of all telephone number(s) that I have or will provide to ADT to contact me. If I have provided or do provide ADT with an email address, 1 agree that ADT may send me emails regarding my ADT Services or new ADT or third -party products and services. I may unsubscribe or opt out by calling 877.776.1911. Signatures This Agreement is not binding upon ADT unless and until either signed by an Authorized blanager of ADT, or we begin the installation of equipment or provision of services to you. You acknowledge that you may not receive a copy of this Contract signed by ADT's Authorized Manager, but such lack of receipt shall not, in any way, invalidate or otherrAse affect this Contract.
