HomeMy WebLinkAboutSecond Amendment To Tower Lease with Optionf�1 r� SECOND AMENDMENT TO TOWER LEASE WITH OPTON This Second Amendment to Tower Lease with Option (the 'Amendment") is effective September 15, 2006, between Mary Jane D. Spain, dlb/a Microwave Service Company ("Landlord"). and T-Mobile South LLC, a Delaware limited liability company, as successor in interest to Omnipoint Holdings, Inc. ("Tenant"). WHEREAS, Landlord and Tenant entered into a Tower Lease With Option dated effective as of May 23, 2002 ((including all prior amendments the `Lease") for placement of Tenant's Antenna Facilities on Landlord's Property; and WHEREAS, Tenant desires to modify its teased Premises in order to install a generator (°Additional Equipment"); WHEREAS, Landlord has reviewed and approved Tenanfs proposed location for placement of the Additional Equipment: NOW THEREFORE, for good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, Landlord and Tenant hereby agree to amend the Agreement as follows: Tenant's Premises is revised to comprise additional ground space of approximately 75 square feet for placement of Tenant's Additional Equipment, as shown on Exhibit A, which is attached hereto and incorporated herein by this reference. 2. Effective as of September 15, 2006, Tenanfs monthly Rent shall be increased to two thousand two hundred and fifty Dollars ($2,250.00) for leasing the additional ground space indicated in Item 1. 3. Except as specifically set forth herein, this Amendment shall in no way modify after or amend the remaining terms of the Lease, all of which shall remain In full force and effect. To the extent there is any conflict between the terms and conditions of this Amendment and the terms and conditions of the Lease, the terms and conditions of this Amendment will govern and control. [Unless otherwise defined herein, capitalized terms used in this Amendment have the same meanings such terms are given in the Lease.
