Overall Scope of Project: South Florida Construction Management & Design, Inc., hereafter referred to as "Contractor", proposes to perform the following services in accordance with the scope of work listed below at the home of Ana Anderson hereafter referred to as "Homeowner" and/or "Owner", Contractor will provide all necessary materials and labor to perform the work according to industry standards. Homeowner is to provide Contractor with continuous access to the site, electricity and water (at no additional cost to the Contractor). The work includes the following: 1. Remove roof coverings down to decking. 2. Re nail roof decking to the current building code. 3. Replace deteriorated decking as needed up to 3 sheets after 3 sheets $200.00 per sheet 4. Install 30# felt paper 5. Install new APV (vents) 6. Install new lead pipes to all plumbing stacks. 7. Install drip edge 8. Install GAF or Owens Corning Dimensional shingle on Slope deck customer to choose color 9. Install GAF ELASTOFLEX FIRE RATED SYSTEM ON FLAT DECK 10. Warranty for workmanship will be for 5 years 11. Clean up and cart away all job related materials. TOTAL COST FOR REROOFING IS ------------------------------------ $17,500.00 NOTE COST OF PERMIT AND ENGINEER FEES NOT INCLUDED IN COST 1. $ 3,500.00 DOWN AT SIGNING OF CONTRACT 2. $ 3,500.00 AFTER TEAR OFF 3. $ 5,000.00 AFTER DRY IN (READY FOR TILE INSTALL) 4. $ 5,000.00 AFTER FINAL INSPECTION FROM THE BUILDING DEPARTMENT NOTE ANY ADDITTIONAL WORK PERFORMED NOT IN THE CONTRACT WILL BE BILLED AND PAID FOR AS COMPLETED Disclosure: This agreement is based on a take -off performed by the Contractor's estimating department based on existing conditions of the Owner's building. Contractor is not responsible for the quality, craftsmanship, compatibility of any construction materials and shall not be responsible for the timely delivery of any construction materials not directly provided by Contractor. The Contractor is not responsible for any delays or stoppages incurred on the job site due to a lack of materials, untimely delivery dates or long lead times for any material, fixture or accessory not purchased by or directly supplied by Contractor. Contractor may terminate this agreement immediately for its convenience at any time. Contactor may also terminate this agreement at any time if the Homeowner breaches its obligations hereunder. Contractor assumes no responsibility for the fit and finish of any product supplied by the Homeowner and/or their agents. The failure of Contractor to perform any obligation under this agreement by reason of any cause beyond its control (and due to no fault of its own), including, without limitation, acts of government, riots, wars, terrorist acts, natural disturbances, transportation difficulties, acts of god, arson, tropical storms or depressions, wind driven rain, tornados, lightning strikes, hail, heavy rain, wind storms, earthquakes, human abuse, theft, neglect, improper maintenance procedures, strikes and accidents in transportation or any other cause beyond Contractor's control, shall not be deemed to be a breach of this agreement and any performance requirements of Contractor referenced in this Contract shall be extended during this Force Majeure event for the respective period of interruption. Acceptance of Proposal: All work will be completed in accordance with industry standards. Any alteration or deviation from the above specifications will be executed only upon written orders signed by Contractor and will incur an extra charge or deduction depending on alteration/deviation paid by Owner. Contractor's workers are covered by liability insurance. Proof of such is available upon request of Owner or agent thereof. The above prices, specifications and conditions of this contract have been fully read, understood and hereby accepted by both parties. Work is hereby authorized by the Homeowner. Payments will be made according to the above mentioned Terms of Payment. Both parties are of the understanding that should payments not be received in a timely manner, all work will be halted until required payments are received. Time is of the essence regarding Homeowner's responsibility for tendering payments hereunder. Any balances that go unpaid when due shall accrue interest at the rate of One and One Half Percent (1.5%) per month. This agreement is not valid until countersigned by an officer of the Contractor. FLORIDA HOMEOWNER'S CONSTRUCTION RECOVERYFUND PAYMENT MAY BE AVAILABLE FROM THE FLORIDA HOMWONER'S CONSTRUCTION RECOVERY FUND IF YOU LOSE MONEY ON A PROJECT PERFORMED UNDER CONTRACT, WHERE THE LOSS RESULTS FROM SPECIFIED VIOLATIONS OF FLORIDA LAW BY A LICENSED CONTRACTOR. FOR INFORMATION ABOUT THE RECOVERY FUND AND FILING A CLAIM, CONTACT THE FLORIDA CONSTRUCTION INDUSTRY LICENSING BOARD AT THE FOLLOWING TELEPHONE NUMBER AND ADDRESS: DIVISIONS OF PROFESSIONS CONSTRUCTION INDUSTRY LICENSING BOARD 1940 NORTH MONROE STREET TALLAHASSEE, FL 32399-0783 PH: 850-487-1395 STATE OF FLORIDA CONSTRUCTION LIEN LAW ADDENDUM ACCORDING TO FLORIDA'S CONSTRUCTION LIEN LAW (SECTIONS 713.001-713.372 FLORIDA STATUTES), THOSE WHO WORK ON YOUR PROPERTY OR PROVIDE MATERIALS AND SERVICES AND ARE NOT PAID IN FULL HAVE A RIGHT TO ENFORCE THEIR CLAIM FOR PAYMENT AGAINST YOUR PROPERTY. THIS CLAIM IS KNOWN AS A CONSTRUCTION lien. IF YOUR CONTRACTOR OR A SUBCONTRACTOR FAILS TO PAY SUBCONTRACTORS, SUB -SUBCONTRACTORS, OR MATERIAL SUPPLIERS, THOSE PEOPLE WHO ARE OWED MONEY MAY LOOK TO YOUR PROPERTY FOR PAYMENT, EVEN IF YOU HAVE ALREADY PAID YOUR CONTRACTOR IN FULL. IF YOU FAIL TO PAY YOUR CONTRACTOR, YOUR CONTRACTOR MAY ALSO HAVE A lien ON YOUR PROPERTY. THIS MEANS IF A lien IS FILED YOUR PROPERTY COULD BE SOLD AGAINST YOUR WILL TO PAY FOR LABOR, MATERIALS, OR OTHER SERVICES THAT YOUR CONTRACTOR OR A SUBCONTRACTOR MAY HAVE FAILED TO PAY. TO PROTECT YOURSELF, YOU SHOULD STIPULATE IN THIS CONTRACT THAT BEFORE ANY PAYMENT IS MADE, YOUR CONTRACTOR IS REQUIRED TO PROVIDE YOU WITH A WRITTEN RELEASE OF lien FROM ANY PERSON OR COMPANY THAT HAS PROVIDED TO YOU A "NOTICE TO OWNER." FLORIDA'S CONSTRUCTION LIEN LAW IS COMPLEX, AND IT IS RECOMMENDED THAT YOU CONSULT AN ATTORNEY. I/we hereby agree to the terms and conditions of the proposal and the attached terms and conditions which are incorporated herein by reference and approve the scope of work.
