LUCIE COUNTY, FLORIDA WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request for a Minor Adjustment to the Major Site Plan for the project known as Atlantis by the Sea — Gated Entry including the comments of the Development Review Committee, and has made the following determinations: 1. Shaun G. Mackenzie, PE, representing Atlantis Condominium Association, Inc. presented a petition for a Minor Adjustment to the Major Site Plan known as Atlantis by the Sea — Gated Entry, to install two (2) entry access gates to the north and south entrance of Atlantis by the Sea Condominiums. The subject properties are at 10200 1 101021 10152 South Ocean Drive, Jensen Beach, FL as described in Part B below. 2. The Development Review Committee reviewed the proposed site plan for the project and found it meets the technical requirements of the St. Lucie County Land Development Code and has satisfied the standards of review set forth in Section 11.02.07, Standards for Site Plan Review, of the St. Lucie County Land Development Code. 3. Planning Staff has performed a detailed analysis of the project and determined it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is located in the Planning and Development Services Department memorandum titled Atlantis by the Sea — Gated Entry - Minor Adjustment to the Major Site Plan (SPMn-12202025902), dated February 25, 2021. 4. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 5. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through site design, landscaping, and screening. 6. The proposed project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with St. Lucie County Land Development Code requirements. NOW, THEREFORE, BE IT ORDERED: A. Pursuant to Section 11.02.04(C) of the St. Lucie County Land Development Code, the Minor Adjustment to the Major Site Plan is hereby approved as shown on the entry gate site plan prepared by Mackenzie Engineering & Planning, Inc., date stamped by the Planning & Development Services Department on December 3, 2020, and revised on February 22, 2021, subject to, the following conditions: PDS Order 2021-012 Page 1 File No.: SPMN—12202025902 1. Prior to issuance of a Certificate of Occupancy all Category I listed invasive species shall be eradicated from the site. 2. Prior to the St. Lucie County Building Department final approval, Atlantis by the Sea must provide access information to St. Lucie County Utilities so that 24-hour access is available in the event of a utility service emergency. B. The property on which this Minor Adjustment to the Major Site Plan is being granted is described as follows: LEGAL DESCRIPTION: ALL OF THAT PART OF PARCELS A,B,C,D, AND THE NORTH 200 FT. OF G (AS MEASURED ALONG THE EAST LINE OF SAID PARCEL G), LYING EAST OF STATE ROAD A-1-A, ACCORDING TO THE SURVEY OF THE S1/2 OF GOV'T LOT 5, SEC. 2 AND THE NORTH 605.23 FT. OF GOV'T LOTS 1 AND 2, SEC. 11, TWP. 37 S, RGE 41 E, AS SHOWN IN PLAT BK. 7, PG. 13, PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. CONTAINING: 11.27 ACRES (OVERALL) MORE OR LESS. Parcel I D(s): 4511-518-0000-000-1, 4502-801-0009-000-5, 4502-802-0000-000-5, 4502- 803-0000-000-8. C. This Minor Adjustment to the Major Site Plan shall expire within twenty-four (24) months of the effective date of this Order, unless a building permit is issued or an extension is granted in accordance with the provisions of Section 11.02.06 of the St. Lucie County Land Development Code. , D. The developer, including any successors in interest, is advised as part of this Minor Adjustment approval, all applicable development permits and construction authorizations shall be obtained from the appropriate State and Federal and Local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and South Florida Water Management District, and the St. Lucie County Environmental Resources, Public Works, and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. A copy of this Order shall be attached to the site plan drawings described in Part A (A-1 & A-2), which plan shall be placed on file with the St. Lucie County Planning and Development Services Department and mailed to the developer and agent of record as identified on the site plan application. F. The conditions set forth in Part A are an integral non -severable part of the site pan approval granted by this Order. If any condition set forth is Part A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this order shall become null and PDS Order 2021-012 Page 2 File No.: SPMN—12202025902 i A i invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this order shall become null and void. G. The Site Plan, attached as Exhibit "A", shall be valid for the same period as this order. H. The Certificate of Capacity exemption, attached as Exhibit "B", shall be valid for the same period as this Order. If the Order expires or otherwise terminates, the Certificate of Capacity exemption shall automatically terminate. I. This order shall be recorded in the Public Records of St. Lucie County.
