Background
The Environmental Resources Department (ERD) :is .tn •receipt'-pf -the October 5, 2012 Planning
and Development Services':.da.#e-stamped submittal. The:,Applicant requests approval of a minor
site plan in order to construct -a 3,960 SF, s,114 s#ory building between the two existing structures
on the subject praperiies. Environmental Resources staff has completed a site visit and review.
The project site consists of two parcels, located ..adjacent to the St. Lucie County Airport, north of
Industrial Avenue:3.,, . The project site is 3.0 acres,'_the majority of which has been developed as an
industrial warehouse4acility,, Yegeta_tion onsite consists of multiple native oak and cabbage palm
trees, along with a non-na...ve'-t�forFolk lsi�nd pine tree.

The project proposes #o impact five (5) live oak trees and one cabbage palm tree meeting or
exceeding the native tree. preservation thresholds as outlined in Land Development Code Section
6.00.05(0). The impacts:Ap the oak trees total 106 inches diameter at breast height (DBH). The
impacts'wr;li be mitigatecllltough onsite preservation of 6 cabbage palm trees and three live oak
trees, totaring :120 inches -.diameter at breast height. In addition, a landscape plan consistent with
St. Lucie County Land :Development Code 7.09.04 has been reviewed and approved by ERD.
The two parcels are. located within a known scrub jay habitat. The applicant submitted a scrub jay
survey to the US Fish and Wildlife Service, who determined in an email dated September 7, 2012,
the new construction would not pose a significant risk to any scrub jays.
Recommendation
ERD staff supports the Planning and Development Services recommendation of approval with
conditions as outlined below.

Conditions of Approval
1) The County's issuance of development approval does not constitute compliance with any
federal and state requirements.. Applicable, federal and state approvals/permits are required
prior to the commencement of any development activity (i.e. clearing, grading, removing
structures, etc.). The responsibility for contacting federal and state agencies, procuring
permits/approvals and compliance with applicable laws are the sole responsibility of the
applicant.
2) Per Florida Statute 125.022, the issuance of development ; poval does not create any
..
liability on the part of the county if the applicant fails to obtaltuisite approvals or fulfill the
obligations imposed by a state or federal agency or undertrtai6esactions that result in a violation
of state or federal law.
3) Copies of all applicable state or federal permits/written approvals of`frequired by the County
prior to issuance of a Vegetation Removal Permit arlcl any developmeri -.' tottyity.
