FOR AN ADDITION TO AN EXISTING BUILDING IN THE AIRPORT INDUSTRIAL PARK., WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the application for Minor Site Plan approval submitted by Aero Shade Technologies, Inc. and the comments of the St. Lucie County Development Review Committee on this application and made the following determinations. 1. Aero Shade Technologies, Inc. requested a Minor Site Plan to allow for a 3,960 s.f. addition to an existing 22,415 s.f. building. The subject 3.00 acre property is zoned IL (Industrial, Light) and is located at 3104-3106 Industrial Avenue Three, Fort Pierce, FL as described in Part B below. 2. The Development Review Committee reviewed the site plan for the proposed project and found it to meet the technical requirements of the St. Luce County Land Development Code and to be consistent with the St. Lucie County Comprehensive Plan. 3. The project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety and general welfare. 4. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping and screening. 5. The project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with St. Lucie County Land Development Code requirements. 6. The project is to be served by Fort Pierce Utilities Authority (FPUA) water and wastewater services. 7. The applicant has applied for -and received a Certificate of Capacity, a copy which is attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land Development Code. Pursuant to Section 11.02.03 of the St. Lucie County Land Development 4 Code, the Minor Site Plan known as Aero Shade Technologies, Inc. is hereby 5 approved as shown on the plan drawings' for the project prepared by Land 6 Design South dated October 2, 2012 and date stamped received by the St. 7 Lucie County Planning and Development Services Department on October 5, 8 2012 on the property described in Part B, subject to the following conditions: 9 10 ' 1. The County's issuance of development approval does not constitute 11 compliance with any federal and state requirements. Applicable 12 federal and state approvals/permits are required prior to the 13 commencement of any development activity (i.e. clearing, grading, 14 removing structures, etc.). The responsibility for contacting federal and 15 state agencies, procuring permits/approvals and demonstrating 16 compliance with applicable laws is the sole responsibility of the 17 applicant. 18 19 2. Per Florida Statute 125.022, the issuance of development approval 20 does not create any liability on the part of the County if the applicant 21 fails to obtain requisite approvals or fulfill the obligations imposed by a 22 state or federal agency or undertakes actions that result in a violation 23 of state or federal law. 24 25 3. Copies of all applicable state or federal permits/written approvals are 26 required by the County prior to issuance of a Vegetation Removal 27 Permit and any development activity. 28 29 B. The property on which the Minor Site Plan approval is being granted is 30 described as follows: 31 32 LOTS 1 AND 2, BLOCK 7, AIRPORT INDUSTRIAL PARK UNIT ONE, AS 33 RECORDED IN PLAT BOOK 12, PAGE 40, OF THE PUBLIC RECORDS OF 34 ST. LUCIE COUNTY, FLORIDA. 35 36 Parcel Identification Number: 1429-501-0105-0004 37 38 C. The Minor Site Plan approval granted under this administrative order is specifically conditioned to the requirement that the property owners, successors and assigns in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal regulatory authorities including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part B. E. This Order shall become effective upon the date of approval indicated below. Should any aggrieved party wish to appeal any condition described in Part A above, all such appeals must be filed in writing to the Board of Adjustment within 30 days of the rendering of this Order, as described in Section 11.02.03.13, St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. F. A copy of this Order shall be attached to the site plan drawings described in Part A, which shall be placed on file with the St. Lucie County Planning and Development Services Director and mailed, return receipt requested, to the developer and agent of record as identified on the site plan application. G. The conditions set forth in Part A are an integral nonseverable part of the site plan approval granted by this Order. If any condition set forth in Part A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this Order shall become null and void. H. The Certificate of Capacity, attached as Exhibit A, shall be valid for the same period as this Order. If this Order expires or otherwise terminates, the Certificate of Capacity shall automatically terminate. i I. This Order shall be recorded in the Public Records of St.. -Lucie County.
