Edwing's Unlimited Shutter Service, LLC. and the Purchaser agree to the sale and installation of the above specified price upon the terms and conditions hereinafter set forth and continued on the reverse side of this contract. The terms and condi- tions set forth on the reverse side of this contract, including the_description and limitations of all warranties end guarantees are incorporated into this contract as is fully set in this page. 2. This agreement shall be binding upon the parties hereto, their Heirs, Successors, and Assigns, where singed by the parties hereto or their Owner as said person represents that he is the owner or his lawful Agent with actual authority to bind the Owner. 3. PURCHASER'S RIGHT TO CANCEL This is a home solicitation sale and if you do not want the goods or services, you may cancel this agreement by mailing a notice to the Seller. This notice must indicate that you do not want the goods or services and must be postmarked before midnight of the third business day after you sign this agreement I HAVE READ THE FORGOING TERMS AND CONDITIONS OF SALE SET FORTH ON BOTH SIDES FREIN t7 AGREE WITH THEM. PURCHASER 4. The Signer acknowledges receipt of true copy of contract,,acknowled.ges that he has read both sides and knows the contents thereof, and understands that no other agreement verbal or otherwise is binding upon the parties and that this contract, front and back, constitutes the entire agreement between the Parties. 5. Title, ownership and right to possession of the above described property shall remain with and not pass from Edwing's Unlimited Shutter'Services, LLC. until total amount of contract and charges orders, if any, shall have been paid in full. 6. The parties herein acknowledge that any delivery dates stated on the contract are approximate only. This contract cannot be canceiled,by Customer because of Acts of Riots, Storm or other Acts of God, including shortage of materials and supplies to seller. 7. In the event the Purchaser defaults on any portion of this contract prior to the delivery and installation of the above describe product, the parties herein agree that since it would be impossible to ascertain the seller's damages, the seller shall be entitled to one half (1/2) of the contract price as.and for liquidated and agreed damages; the parties herein acknowledge that said sum is not a penalty. 8. In the event the Purchaser defaults on installation and/or delivery of the above described property Edwing's Unlimited Shutter Service, LLC. shall be entitled to any and all of the following remedies: (a) To sue Purchaser for the balance due and recover all cost, including reasonable attorney's fees and 1 1/2% per month interest on unpaid balance or portion thereof; (b) to enter the premises with out notice and repossess the above described property, (Edwing's Unlimited Shutter Service, LLC shall not be responsible for any damages to the!Purchaser's property caused by the repossession of the above described property); (c) Retain all sums previously paid. 9. Edwing's Unlimited Shutter Service, LLC. agrees to use due caution in choice of mounting holes, location of brackets, etc., but assusmes no responsibility whatever to concealed lines, such as but not limited to electrical, alarms, water or air conditioning or damage to wall surface. 10. EDWING'S UNLIMITED SHUTTER SERVICES, LLC. WILL NOT MAKE INTERNAL CONNCECTIONS TO POWER SOURCES. IF A HURRICANE SHUTTER REQUIRES ELECRTICAL WORK, THE CUSTOMER IS RESPONSIBLE FOR HIRING AND PAYING A CERTIFIED ELECTRICAL CONRTACTOR. BECAUSE OUR PRODUCTS ARE NOT AN INTEGRAL PART OF THE ORIGINAL STRUCTURE, THEY CANNOT BE CONSTRUED AS BEING ONE HUNDRED PERCENT WATER TIGHT. LIMITED WARRANTY Edwing's Unlimited Shutter Service, LLC. warrants to the ORIGINAL purchaser on all Rolling Shutter Parts and Accordion shutter parts, under separate warranty, 5 years parts, .1 years labor, and 2 year on motor, from date of installation. All other products carry a one (1) year warranty ONLY. This warranty does not apply to any parts which have been subjected to misuse, neglect, and damage by fire, floods, Acts of God or any other form of casualty, including failure to follow instructions for Care and Maintenance. In' no event shall Edwing's Unlimited Shutter Service, LLC., be liable for consequential damages nor shall Edwing's Unlimited Shutter Service, LLC., liability or claims for damages arising out of or connected witFi the contract, manufacture; sale, delivery of use of any products ever exceed the price paid thereof. Although every effort is made to include the finest materials available, Edwing's Unlimited Shutter Service, LLC. does not warrant against deterioration and/or peeling, of finished surfaces due to exposure to sun, salt, the elements of abrasions, including but not limited to minor blemishes incurred in manufacturing, shipping or installation. - Any adjustment made under this warranty does not void the warranty nor does it imply an extension of the original period. Products serviced and/or replaced during the warranty period carry only the unexpireportion of the original warranty period. THERE ARE NO OTHER EXPRESS WARRANTIES EXCEPT AS STATED HEREIN, THERE ARE NO EXPRESS OR IMPLIED. WARRANTIES AND THOSE EXCLUDED INCLUDE THOSE OF MERCHANT ABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
