The above parcels are nonconforming because they do not have the required road frontage of 30 feet. In order for a parcel to be considered a nonconforming lot of record and thereby qualify for a waiver of this requirement, it must exist in separate ownership and not be contiguous to other lots in the same ownership prior to July 1, 1984 pursuant to Section 10.00.04, LDC. I researched county records and found that the parcels referenced above were not contiguous to other parcels in the same ownership prior to July 1, 1984. Please be advised, however, that the two parcels above were under the same ownership in July 1984 and are considered one nonconforming lot of record pursuant to our Code. As a result, frontage is hereby waived for the above referenced property. One single family home may be constructed on the 2.5 property subject to meeting all applicable local, state, and federal codes. Please contact the health department regarding well and septic at (772) 873-4903 to ensure that their requirements can be satisfied prior to applying for a building permit for the subject property. You will also need to do a combination of parcels through the Property Appraiser's office prior to applying for a building permit. The combination of parcels will result in the issuance of one parcel identification number. In -addition, please provide evidence of the easement that provides access to the property when you apply for your building permit.
