Request for Verification of Exemption from an Environmental Resource Permit
You have successfully submitted a request for Verification of Exemption from the Environmental Resource
Permit (ERP) requirements of Part IV of Chapter 373, F.S., and Chapter 62-330, F.A.C.. Your request was
received on May 10, 2021.
You have indicated that your project does not include any dredge or fill activities in wetlands or surface
waters assumed by the State of Florida under Section 404 of the Clean Water Act.
You HAVE waived, in accordance with Rule 62-330.050(10), F.A.C., the 30-day deadline for issuance of
the verification set forth in Rule 62-330.050(4), F.A.C. in the event your project also requires a State 404
Program authorization (other than an exemption) under Chapter 62-331, F.A.C., and requested that the
agency actions for the ERP exemption and State 404 Program authorization be issued at the same time.

Project Description:
The applicant proposes to replace an existing 172-linear foot seawall within 18 inches of its current
location. The applicant also proposes to install up to 35 batter/king piles for stabilization, and proposes to
remove and replace an existing 326 square foot dock. The existing boatlift and roof will remain in place.

Wetlands Information:
The proposed dock replacement/reconfiguration is less than 1,000 square feet in a residential canal and
will not impede navigation. The proposed dock is for single-family use only. The proposed replacement
172-foot seawall will be installed within 18 inches of the existing seawall and is intended for shoreline
stabilization of a single-family residence. Seawall replacement will include only the backfilling needed
to level the land behind the seawall. The proposed installation of batter piles/king piles is to be used
exclusively to stabilize and repair an existing seawall, and will not impede navigation.
Erosion Control Information:
Standard turbidity curtain and other typical construction erosion control measures will be used during
construction activities to contain any sediments and silt that may be disturbed.
Additional Information:
Please notify us regarding SPGP and 404 status as soon as possible; JAXBO PDC checklists are
attached. No seagrasses are expected in the North Fork St. Lucie River as it is predominantly freshwater
- shoreline vegetation across the canal included red maple (Acer rubrum) and leather fern (Acrostichum
danaeifolium), both of which indicate more fresh water conditions. If an in-season seagrass survey is
required for this site, please notify us ASAP and we will schedule one in early June (within the 30-day
timeclock). Thank you!
