September 18, 2012 •� /� j Mario Arbucci Oceanfront Builders of the Treasure Coast 3462 SE Dixie Hwy Stuart, FL 34997 Re: Kress Residence 5032 Watersong Way Ft Pierce, FL 34949 Dear Mario, I am writing today in an effort to resolve remaining roof work issues at the above referenced address. We have completed our work, but have yet to receive our final payment. We understood that you had some minor issues, mainly cosmetic in nature that you wanted to address. However, when we met with you at a site visit yesterday, you refused to innumerate any punch list items. There were not any defects apparent with any of the roof work. You indicated you were pleased with the workmanship and appearance of the upper roof, but had remaining issues with the lower roof. Our inspection turned up no problems with any of the roof areas. The lower roof installation is consistent with that of the upper roof, and with roofs on theother-.homes at Watersong. We used the same materials and the same installation methods. The roof passed final inspection by the Building Department on September 7`h, meeting all code regulations and requirements for the county. Although we have made best efforts throughout the term of this contract to meet your requirements, even those outside of the normal procedures followed by most of our customers, you have not held up your end of our contract by making timely payments. It has left us wondering if you ever intended to honor the contract between us. As you are aware, we have filed a lien on the property in an attempt to recover the balance rightfully due for our work. As this has not incited you to honor our demand for payment, we feel we will be forced to take further action, including but not limited to contact with the Better Business Bureau and the Florida Department of } Business and Professional Regulation. Please be assured that these will be last resort actions and we prefer to close our contract in a professional and amiable manner. We are asking that you pay the balance due within one week's time.
