Mr. & Mrs. Coffey are in the process of requesting the abanclonment� of Poinsetta� Ave between
Oak Avenue and Royal Palm Blvd, In the meantime, they are asking for a Rev9cable License
Agreement to use the unopened, unmaintained Poinsetta Avenue asitheir setback for the shed
they want to install on their property. The shed is going to be delivered sooner than the
abandonment will be approved. Since this right-of-way is unopened and unmaintained they are
asking if they will be allowed to use it for their shed permit showing it as their side setback until
the abandonment is approved.
Your comments for request would be appreciated by December 15,12017 in order to schedule
their request before the Board of County Commissioners. i I

REVOCABLE LICENSE AGREEMENT

THIS AGREEMENT made and entered this day of �2018, by and
between ST. LUCIE COUNTY, a political subdivision of the State of Florida (the '!County") and
MICHAEL A. COFFEY and TRACIE COFFEY, 1200 Oak Street, Fort Pierce; FL 34982 ("Owners").
WHEREAS, the Owners own the property described as follows:! i
LOCATION —1200 Oak Street, Fort Pierce, FL

WHEREAS, the Owners desire to use Poinsetta,Ave 'on the 'side of their property for
setback requirements for a shed they would like to install on their proIperty.
WHEREAS, the County is willing to permit the Owners to use,Poinsetta Ave for setback
requirements for their shed. This area will be maintained subject to the terms and conditions
set forth in this Revocable License Agreement. The property o i ners are working on an
abandonment package to abandon a portion of the unopened un aintainea Poinsetta Ave.
Once this is approved the Poinsetta Ave right-of-way will become part of the Owners' property
and the Revocable License Agreement will not be needed,
NOW, THEREFORE, in consideration of the mutual covenants stet forth herein, the parties

agree as follows:
1. The County agrees to grant the Owners,a Revocable license Agreementfor the
i
purpose of using Poinsetta Avenue as part of their,setback requirements,_ see location in Exhibit
"A". This license shall extend only to set backs. This license shall not extend to the
construction and/or installation of any additional structures, utlitiesl in this right-of-way at this
time.
2. The sole purpose of this Revocable, License Agreement is to givethe Owner setback
I' {requirements on the unopened, unmaintained portion of Poinsetta Avenue.
3. Pursuant to the terms and conditions contained in this Agreement, the County

authorizes the Owners to use Poinsetta Avenue as their setback requ�irements!so they can install
a shed on their property.
4. The Owners are required to have a licensed contractor perform any work on.the
shed that is located on their property, if needed, in accordance with! Standard S iecifications for
Public Works Construction in St. Lucie County, Florida, together with a Maintenance of Traffic
Plan, if needed, for approval prior to construction and provide notice jto the County Engineer with

a schedule for construction.
S. This Revocable License Agreement shall be binding on future successors and
assignees of the Owners provided that Owners gives adequate noticie to the County pursuant to
Paragraph Twelve (12) of this Agreement.

6. The County shall have the right, at the sole discretion of the County Engineer, to
terminate this Agreement with or without cause and require removal of the she d and pad and
repair of the road at the Owners' sole expense upon ninety (90)1 days written notice to the
Owners. The County Engineer may, in lieu of termination, requel t that the Owners perform
certain alterations to the right-of-way area in the Poinsetta Avenue Iright-of-way; at the Owners'
sole expense. However, if such alteration is not performed to the satisfaction of the County
Engineer, the County shall be entitled to exercise its right to terminate this Agreement.
7. Upon the abandonment of the setback area, the &piration o t this Revocable
License Agreement, or the revocation of this Revocable License Agreement, whichever occurs
first, the Owners shall be responsible for the re -sodding or plugging of the abandoned setback
area as directed by the County Engineer, consistent with the.specifications of the County in force
at such time.

8. The term of this Revocable License Agreement shall begin on the date first above

written and shall remain in effect unless otherwise revoked or abandoned as provided herein.
9. Owners agrees to relocate the shed at any time and at no cost to the County, if
I
necessary for the maintenance or improvements of Poinsetta Avenue by the�Co�unty.
10. The setback area in the right-of-way of Poinsetta !Avenue shall be maintained
solely at the expense of the Owners. Any maintenance activity will be subject to the written

approval of the County Engineer.
11. The Owners agrees to allow County employees access to the location of the

setback area for County purposes as determined by the County Engineer.

delivered by messenger or carrier service, telecommunicated, or mailed by registered or certified
mail (postage prepaid) return receipt requested, address to:

section. Each such notice shall be deemed delivered (a) on the date deliveredif by personal
delivery, (b) on the date; upon which the return receipt is signed of ) delivery is 'refused or the
notice is designated by the postal authorities as not deliverable, as the case mpy be, if mailed.
13. The Owners shall indemnify and hold the County harmless from ,and against all
claims liability, demands, damages, expenses, fees, fines penalties,�suits, proee{{iedings, actions
and costs of actions, including reasonable attorney's fees of any kind or nature alrising or in any
way connected with the use, occupation, management, or control of the aboi e property by
County or its' agents, servants, employees, patrons, or invitees, or resulting in injury to persons
or property, or loss of life or property of any kind or nature whatsoever, sustained during Owners'
use of the property, excluding costs, damages and liabilities resulting from the' negligence or
willful misconduct of County, its agents, employees, representatives or contractors.
14. The Revocable License Agreement shall be recorded in the OfficialI Records of St.
Lucie County, Florida. The Owners shall pay any document excise taxes and the cost of
recording this Revocable License Agreement.
