LUCIE COUNTY SEA TURTLE PROTECTION PLAN BEACHFRONT LIGHTING APPROVAL REQUIREMENTS Prior to the issuance of a Certificate of Occupancy, com- pliance with the beacnfront lighting standards set out in the Sea Turtle Protection Plan (STPP) shall be approved as follows: A. Upon completion of the construction activities, a regis- tered Florida architect or professional engineer shall con- duct a site inspection which includes a night survey with all the beacnfront lighting turned on. B. The inspector shall prepare and report -the 'inspection - findings in writing to the Planning Division identifying: 1. The date and time of initial inspection. 2. The extent of compliance with the STPP. 3. All areas of potential and observed non-compliance with the STPP. 4. Any action(s) taken to. remedy observed non-compliance, if applicable. 5. The dates) and time(s) of remedial inspection(s), if applicable. C. The inspector shall sign and seal the inspection report in the following manner: I HEREBY CERTIFY THAT: 1. SPECIAL LIGHTING RESTRICTION OURING THE NESTING SEASON All exterior lignt sources directly visible- from the beach or illuminating areas seaward of the primary dune snail be turned off after 11:00 P.M. each night during the nesting season (May 1 tnrougn October 31). - NEW COASTAL CONSTRUCTION 1. A Sea Turtle Protection Plan.(STPP) snail be. approved prior. to the issuance of a building permit or approval of a site plan. [58(l)] - 2. Upon completion of construction, beacnfront lighting snail be approved prior to the issuance of a Certificate of Occu- pancy. [60(9)] 3. Construction snail be encouraged from November 1 through April'30. Any construction between May land October 31 snail be encouraged during daylight hours. [58(2)] 4. Temporary nighttime security lignting should be limited in number. High intensity lighting for decorative or accent purposes is prohibited. [60(4)(a)] 11. The use of high intensity lights for safety and security purposes shall be limited. [60(4)(b) ] 12. High intensity lights shall not illuminate the beach. Their source shall not be seen from the beach. [60(4)(c)] 13. Low intensity lights shall not illuminate the beach. [60(5)(a)] 14. Balcony lights shall be shielded from the beach. [60(5)(b)] 15. Low intensity parking lot lights within line of sight of the beach shall be set on a base which raises the source of light no higher than .forty-eight (48) inches off, the ground and positioned and/or-snielded so the source of light is not visible from the beach. [60(5)(c)] 16. Tinted glass pr window film is required on all windows for single/multi-story structures within line of sight of the beach. [60(6)] 17. Vehicular and parking areas should be designed and/or posi- tioned so that vehicular headlights do not cast light toward the beach. [60(7)(a)] 18. Ground level barriers are required to shield vehicular lighting from the beach. [60(7)(b)] 19. Lighting. for pedestrian traffic, on or seaward of the dune, shall use the minimum amount of light necessary to ensure safety. [60(8)(a)] 20. Pedestrian lighting shall be of low intensity ano recessed or shielded so that the source of light is not directly visible from the beach. [60(8)(b)] CONSTRUCTION SEAWARD OF THE DUNES 21. Protective/mitigative measures are required for all con- struction seaward of the dune during nesting season (May 1 through October 31) [58(3)] 22. Protective/mitigative measures shall include, but not be limited to: a. A preliminary site survey (unless exempt) and daily nesting surveys,,,.botn by,state approved agents, and relocation of all sea turtle nests to a safe habitat. b.. Construction delays for sixty (60) days if known nests cannot be .relocated.-, Daily nesting surveys may prevent delays. cv Exclusion fences if state -approved: d. 'Daily .records of �--sea 't'u'rtle monitoring. [58(6) ] NEW BEACH ACCESS POINTS 23. Pedestrian traffic shall be directed and limited to beach access points provided with dune crossovers. [63(1)] 24. Sea turtle information signs shall be posted at all new public beach access points provided with dune crossovers. The information signs shall be: a. Standardized by the Planning Division. b. Provided by the County. C. Installed and maintained by the property owner. Information signs shall be encouraged at all new private beach access points provided witn dune crossovers. [63(2�-j- 25. Sea turtle information signs shall be maintained so that the information remains legible and the signs are conspicuous to persons at all public beach access points. Maintenance of sea turtle information signs at private beacn access points shall be encouraged. [63(4)] BEACH -DUNE PRESERVATION, STABILIZATION AND RESTORATION PROJECTS 26. The use of continuous, rigid, fixed above ground structures and materials which provide limited or no beach access to sea turtles or eliminates portions of the beach -dune system as a nesting habitat, such as seawalls and rip -rap, shall be pronibited except when: a. Used as part of a comprehensive plan for beach -dune restoration. b. Non-structural alternatives are unacceptable. C. Such structures and mat.erials can be convincingly demonstrated to nave no negative impact on water quality, the natural habitat, adjacent shore areas or beach use. [65(1)] 27. Buried, 'emergent or above -ground structures shall be designed and/or positioned so that they do not act as traps: - to sea turtles. [65(2)] 28. Any impenetrable, buried, synthetic materials used for beach and dune preservation, stabilization or restoration projects shall be sufficiently covered by beach sediments and main- tained in such a state to allow for normal sea turtle nesting. [65(3)] 29. Restored and stabilized beaches and dunes shall comply with the following, as applicable: a. Restored beaches shall resemble the characteristics of pre-existing or adjacent natural beaches. b. Restored and stabilized dunes shall be, similar in appearance to pre-existing or adjacent natural dunes. C. Restored and stabilized dunes shall be designed so .that the reconstructed dune profile does not effectively exclude access by nesting sea. turtles. [65(4)] 30. Tne use of natural dune vegetation shall be encouraged, and the design and/or operation of sprinkler systems to promote or sustain growth of dune vegetation snail: a. Be approved by the Planning Division prior"to instfalla tion. b. Not interfere with the normal development of sea turtle eggs in the nests or adversely affect emergent natcnlings. [65(5)] 0 A MECHANICAL BEACH CLEANING 31. Beach cleaning shall be conducted during daylight hours and should be limited to the non -,nesting season. [66(2)'J 32. During the nesting season (May 1 through October 31): 33. a. Beach cleaning operations should be limited to the previous high tide mark whenever possible: b. Light -weight motorized vehicles having wide, low - profile, low-pressure tires should. be used to conduct beach cleaning operations. C. Devices used for removing debris from' �the'beach should- -be designed and/or operated -so that ;-they ' do ' not-pene'- trate beach sediments by more than ,two (2)-inches.
