Fencing Required), for a waiver of said fence, there must be a seawall of 4' in height min, above the river/lake bed with adjacent fence extending out over the water. The side setback is 7.5' and the rear is 15', see attached marked survey. 2) Yes, the child barrier is a Building Code requirement, the permanent fence is a St. Lucie County Land Development Code requirement both are required. 3) The privacy fence will be required to completely enclose the yard or pool deck. The rear property line requires to be screened as well, unless the fence is going past the seawall, the seawall is at least 4', and the Building Official has approved the location to be sufficient. Otherwise a waiver will need to be approved by the Board of County Commissioners, see below B procedure for waiver. 4) The fence permit can be submitted during construction of the pool and before final inspection of the pool if the child barrier for the Building Code is applicable. The comment states, "if fenced yard, the setbacks will be measured to the edge of the water. Side setback is 7.5'." Please confirm this is the edge of the pool water? If this is the case, the submitted site plan shows compliance (6.2' to corner of deck plus an additional 3'+ to the pool waterline). Is there any further information you need from us? 2. Since the pool will not receive a pool enclosure, am I required a child safety fence AND a privacy fence? - If so, will the privacy fence be compliant if it attaches at house and extends to the water line and not around the back perimeter? - Do I need to submit a fence permit application prior to pool permit issuance or pool permit final certificate of completion/occupancy?
