The definition of at grade construction would allow this type of construction within any required side or rear yard. I
would not consider a pervious wood deck less than 30" to be an obstruction. If there were utility or drainage easements
in place, we may have a different scenario.

Subject: Code case permit 2103-0283, deck at grade
Good afternoon Ben,
We have a permit in for a deck in the 8' side setback in Ocean Resorts, see picture below. Based on the determination
deck on grade, this deck should be considered deck at grade because it is lower than 30". The deck is built on 2x4
treated wood joists and blocking.
SLC chapter 7.10.16 Q (a-1(b)) indicates the 8 feet side setback should be unobstructed between units. Is this deck
considered obstructed or unobstructed?
