LUCIE COUNTY, FLORIDA 8 9 WHEREAS, the Board of Adjustment of St. Lucie County, Florida, based on the testimony and 10 evidence, including, but not limited to the staff report, has made the following determinations: 13_ 12 1. Mark and Kelly McElwee presented a petition for a Variance from the provisions of 13 Section 7.04.01(Table 7-10), of the St. Lucie County Land Development Code to 14 allow an unscreened pool that encroaches a maximum of 5 feet into the minimum 15 rear setback of 15 feet required in the RS-4 (Residential, Single Family — 4du/ac) 16 Zoning District for the property depicted on the attached maps as Exhibit "A" and 17 described below. 13 1.9 1. On May 24, 2017, this Board held a public hearing on the petition, after publishing 20 a notice of such hearing and notifying bymail all owners of property within 500 feet �} 1 of the subject property. 22 23 3. After consideration of the testimony presented during the public hearing, including 24 staff comments and the standards of review for granting variances set out in 25 Section 10.01.02, St. Lucie County Land Development Code, the Board of 26 Adjustment has made the following determination: 2.7 23 The requested variance has met the standards of review as set forth in Section 29 10.01.02, St. Lucie County Land Development Code and is not in conflict with the 30 goals, objectives, and policies of the St. Lucie County Comprehensive Plan, because 31 32 a) The variance is the minimum required to allow reasonable use of the land. 33 b) The variance granted will not have adverse impacts to other property or 34 improvements in the neighborhood. 35 c) The variance will not affect any neighbor. 36 d) The variance granted is not in conflict with the general spirit and intent of 37 the St. Lucie County Land Development Code and the St. Lucie County 38 Comprehensive Plan. 39 File No.: BA 320175119 BA Resolution 17-003 Page 1 May 24, 2017 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33¢ 34 35 36 37 38 39 40 41 NOW, THEREFORE BE IT•RESt'OLVED by the Board of Adjustment of St. Lucie County, Florida: A. The Mark McElwee petition for a Variance from the provisions, of Section 7,04.01(Table 7-10), of the St. Lucie County Land Development Code to allow an unscreened pool to encroach a maximum of 5 feet into the minimum rear setback of 15 feet required in the RS-4 (Residential, Single Family —4dujac) Zoning District for the property depicted on the attached maps as Exhibit "A" is hereby approved. B. The property on which this Variance approval is granted is described as follows: THE SOUTH 100 FEET OF LOTS 13 AND 14 AND THE WEST 2.2 FEET OF THE SOUTH 100 FEET OF LOT 15, BLOCK 3 OF HARRIS SUBDIVISION, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 3, PAGE 5, OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. Address: 116 Harris Street, Fort Pierce, FL Parcel ID: 3532-503-0041-0006 C. This Resolution shall be recorded in the Public Records.
