Pierce / 68857 LEASE SUPPLEMENT �-�-t„ Lease Supplement ("Supplement"), made this 2l day of . / 20 e� This ppbetween SpectraSite Communications, LLC, a Delaware limited liability company with its principal offices located at 10 Presidential Way, Woburn, MA 01801, with a federal identification number of 56-2011640, hereinafter designated LESSOR and Verizon Wireless Personal Communications LP d/b/a Verizon Wireless with its principal offices at c/o Verizon Wireless, One Verizon Way, Mail Stop 4AW100, Basking Ridge, New Jersey 07920-1097, hereinafter designated LESSEE. 1. This Supplement is a Supplement to that certain Master Lease Agreement between American Tower, L.P. and Cellco Partnership, dated June 11, 1999, as amended by an Amendment to Master Lease Agreement dated April 4, 2002, as amended by that certain Second Amendment to Master Lease Agreement dated July 13, 2004, as amended by that certain Third Amendment to Master Lease Agreement and Existing Agreements dated February 13, 20 2 amended by that certain Fourth Amendment to Master Lease Agreement dated May 2,008, amended by that certain Fifth Amendment to Master Lease Agreement dated August 12, 2009, as amended by that certain Amendment to Agreements dated January 29, 2010, and as amended by that certain Seventh Amendment to Master Lease Agreement dated September 3, 2013, as amended by that certain Amendment to Agreements dated November 7, 2013 ("Agreement"). All of the terms and conditions of the Agreement are incorporated herein by reference and made a part hereof without the necessity of repeating or attaching the Agreement. In the event of a contradiction, modification or inconsistency between the terms of the Agreement and this Supplement, the terms of this Supplement shall govern. Capitalized terms used in this Supplement shall have the same meaning described for them in the Agreement unless otherwise indicated herein. follows: 2. The Property leased by the LESSOR to the LESSEE hereunder is described as A 10' x 24' parcel of property for the placement of LESSEE's equipment pad on the ground, and a 7' x 17.33' parcel of property for the placement of a propane fuel tank within a 10' no spark setback, a three (T) feet wide non-exclusive easement for an ice bridge running from the equipment pad to the Tower, a three (T) feet wide non-exclusive easement around the perimeter of the equipment pad for a grounding ring, and antennas on LESSOR's Tower, together with a non-exclusive easement for ingress, egress and utilities to the nearest public right of way, located on that parcel of land located in St Lucie County, State of Florida and as further identified on Exhibit 1 attached hereto. 3. In the event an Exhibit 1 is attached hereto describing the Property, the LESSEE shall have the right to survey the Property and said survey shall then become Exhibit 2 which shall be attached hereto and made a part hereof and shall control in the event of any discrepancies between it and Exhibit 1. The cost for such work shall be borne by the LESSEE. 4. The initial term of this Supplement shall be for ten (10) years and shall be subject to extension as set forth in Paragraph 2c(2) of the Third Amendment to the Agreement. 5. The rental for the initial term pursuant to this Supplement shall be due at an annual rental of Forty -One Thousand Five Hundred Sixty Six and 08/100 Dollars ($41,566.08) to LESSOR SITE NAME/SITE NUMBER: TPK Ft. Pierce, FL / 302893 LESSEE SITE NAME/SITE NUMBER: ATC TPK Ft. Pierce / 68857 be paid in equal monthly installments on the first day of the month, in advance, to LESSOR, or to such other person, firm or place as the LESSOR may, from time to time, designate in writing at least thirty (30) days in advance of any rental payment date. The Commencement Date shall be the earlier of: (a) the first day of the month in which the Lessor issues to Lessee a Notice to Proceed ("NTP"), or (b) the first day of the month in which Lessor provides Lessee with written notice that the modifications in Section 9.a, below, have been completed. 6. The annual rental shall increase by Three (3%) percent on the first day of September following the commencement of this Supplement and on the first day of each September thereafter, for the initial term and all extension terms. 7. Lessor and Lessee agree and acknowledge that Lessee shall pay to Lessor within thirty (30) days of receipt of an invoice a "Capital Contribution Fee" in the amount of $41,263.00, which fee represents Lessee's contribution for costs associated with tower modifications required to accommodate the installation of Lessee's equipment.
